No, he wouldn't necessarily have visible signs in order for you to get the virus (if you do have it). They say an estimated 80% of people that have genital herpes do not know they have it.

Also, just as a side note, having unprotected sex will increase your risk of getting the virus but you can still get it if you are using a condom since the virus is spread from skin to skin contact (lr secreations from an active sore) and not bodily fluid ..the condom does not cover the whole boxer short area which gives a person a chance to get the virus from a partner.
