Hi
I have gotten denied disability once last year, then this year (as a new case) and now I have a lawyer sending my stuff for the rereview ror whatever they call it. I was diagnosed (finally) with the fm after this past denial.
As a former office mgr and as a hairdresser, neither job is something I can do anymore. I have enough trouble just getting through the day with pain, fatigue etc.
Anyone know any good links/papers/anything? I can help my case along with? SSI says they see I am in pain but should still be able to do my jobs. I cant even vacuum for crying out loud!!Or drive half the time cuz I cant turn my neck! I think my age works against me (32). I do have med records for about 15 years of chronic neck/back pain, a diag. of cervical instablility c4 and 5 are 3.5mm apart and c3 and 4 are 3mm apart as well as the fibro, bursitis and tendonitis. ANy help is appreciated.

Hi. My mother has fibro. as well and we are in the same boat. She was denied last year as well and it seems like forever just to get the case heard again. I hate to say that we have not been able to find any real court cases for fibro. but I would like to say good luck and that you're not alone in your fight to get disability. I think what gets me the most is that I see my mom in pain everyday but these judges see the fibro. patient for a couple of hours and still think they know best. If they only knew. Good Luck. and God bless.

It is possible, at least in Idaho, to get SSI with only the FMS diagnosis, but it takes a lot of documentation of how your symptoms limit your activities and your doctor backing you up. You will get turned down for sure the first time through and probably the appeal. With a lawyer the judge will probably rule in your favor if you can prove FMS has disabled you to the point you cannot provide yourself a living income. This we did with our youngest daughter.

New news on SS. If you cannot do the job now that you were doing, it should be easier now to be declared disabled. One needs to prove that you cannot do today what you did formerly. This is the main goal in seeking disability and you need proof by getting all the information from former employers of what your job duties were.
Sometimes appointments may be set up by SS for performance abilities. If you can't pick up more than three pounds (an example) without pain, be sure to let the evalulater see this. I went through some awful physical and mental tests. Evaluations are stressful but don't try to do your best, it will go against what you deal with everyday. MistyMisty

It just seems that for fibro pts. not only do we have to "prove" our FM all the time to dr's, family etc. that we have to prove it to SSA when it is recognized by the rhemys (at least) as a medical condition. I am going to have a few friends/family write short letters too to let them know what chgs have happened in the past few yrs. Thanx for taking the time to write :)Be well

Hi, I was denied SSDI both my first try and again on the appeal. I then got a lawyer and almost a year and a half from the very first time I applied my lawyer seems to think I won my case in front of the law judge. I still won't see any money to help out with the bills that are piled high until late May probably. My age was a huge factor in getting denied (I'm 29) my law judge looked right at me and said, don't you think you are a little to young to have fibro. I tell you I just wanted to scream because I have read so many posts with people that are a lot younger then me. The reason why my lawyer thinks I won is not because I have fibro but because I have major headaches almost daily, most being migraines. The law judge had a Dr. and a vocational theripist there and had them testify after I was done. Thank god they had things to say in my favor. I wish you all the best and Happy Holidays.

Tawny007-
Thanx for the encouragement. I'm only 32 and this is just a nightmare trying to get some help w/ finances-AND I found out I am expecting again (VERY suprised and very nervous w/my FM being what it is) and hope that doesnt go against me too..I can see it what they will be thinking now... I am a nervous wreck and now feel even worse than usual. I hear ya on those migraines-sometimes I just cry (which makes it worse) cuz they hurt so bad. I hope this lawyer I have can help to work this through. I'm glad to hear it worked out for you. Happy holidays to you too! Be well.

Hi,
you were a fromer office manager and hair dresser that means STANDING ALL DAY. well you cant do that anymore, right?
You need to alternative your standing and sitting in once place because its hurts so much. like every 10-15 mins or prob even need to lie down with the pain your in.
I am telling you this because I got ssd right away with no denial.
I had L 4-5 back surgery in 97-98 and I am still on it with no questions.
also make sure you tell your lawyer you are depressed which allthis pain , I am sure you are a bit.
I stood in all my past jobs.
right now im working 15 hrs a week, trying to anyway, but i still keep my ssd. I make under 800 a month.
now that i have been dxed with fibro, ill prob be on it forever :(
and with the way i feel lately, dont think even those 15 hrs a week
will last :(
anyway......... your lawyer needs to know, you cant do your past jobs, you cant stand that long anymore and need FREQUENT breaks, your depressed, and have fibro and any thing else that you may have..
you hurt CONSTANTLY and nothing helps the pain...when you fill out those papers about : do you have trouble getting dressed PUT YES,
because it hurts when you do..
usually ssd needs to have more than one thing wrong with you before they put u on ssd.
hope this helped a bit

Well congrats... I know how hard this must be on you. I have two kids (ages 6 and 22months) and when I went in front of the law judge he was like who takes care of the little one. I tell you what, I hate these people who are so quick to judge us but have never had to live a day like we do. I wish you all the best and I found it very helpful to let my lawyer as well as the law judge know all of my other problems as well as the fibro. I hope everything works out for you, I will be praying for you and that you have an easy pregnancy and birth, and another little heathly baby. Best of luck!!Tawny007-

Thanx again for the encouragement.
My lawyer said he doesnt see how it could affect my case I guess he is thinking preganancy discrimination?? I got a huge amount of papers from SSD for the reconsideration the other day, and the lawyer is going to write them out for me early next week.
As far as having more than 1 thing wrong, yes, I do, but when I applied I hadnt been formally diagnosed with fm only neck instability, tendonitis in both knees, bursitis in hips, arthritis in hands and severe muscle probs. in neck and back (with med. backup for 15 yrs. and I am only 32) and depression.
Maybe the fm dx will help get this processed.
Thanx for the support all :) Be well.

Have you been approved for SS Disability? I injured my back at work in 2000, and in 2002 I had to have two back surgeries because of that. One of those was a 360 fusion at L5-S1. I have continued to have problems and other symptoms. The doctors say that I have reached my maximum medical improvement and that I have a significant total body impairment, as a result of the injury and surgeries. The restrictions placed on me from the functional test results have prevented me from being able to return to the job that I was working when I injured my back. In trying to get some relief from some of the continuing probems, I have been being treated by a Neurologist for headaches and muscle spasms. This has now led to a diagnosis of fibromyalgia along with bursitis in both of my soulders and hips, and he said that my SI joints were really tender.
I guess that my worry is that now I may never be able to return to ANY job with my former employer, and with this diagnosis, who would hire me? And where is that going to leave me? I'd like to know if you have been through all of this. I am only 39. Thanks.
