I was approved for SSDI and disability from my state retirement fund last year. First of all the letter last year from the state said they would review in 2006. So I was suprised a few months ago when it came up for review. They sent me to see their psychiarist. I got denied, 1st thing I did was request all infor that made them reach that decision. I got it in 2 days. Their dr. said "I absolutley couldn't work, at all", mine says the same thing, and SSDI, ortho from last year says the same thing. Any advice?

Do you have an attorney working with you? I am also applying and have read up all I could and see that a person has a better chance with an attorney.

No, not yet, they have the same appeal provess as SSDI, do I thought I'd try the 1st appeal by myself, sine they will comtinue to pay me untill all appeals are exhausred, Thanks

Definately, DEFINATELY get an attorney. I had my case reviewed this past April. The records used were just for 2003 and I was pregnant from Apr-Dec 2003 so I did not have any treatment for my main problem--Cowden's Disease. It came back saying that I was now able to work. I have had 17 operations in my life, 2 battles with ovarian dysgerminoma, and currently have more cyst/lumps/bumps than normal tissue in various organs. I have extreme short term memory loss and severe side effects from the chemo I had back with the cancer. None of my doctors said I could work. I couldn't possibly afford medical treatment for all my problems. I bawled and bawled when I got the letter saying I could work. Anyway, I was going to try it knowing full well I couldn't but my in-laws pushed me to challenge the case instead. I was going to go at it on my own but my in-laws suggested a lawyer.
I paid the lawyer for last month and received word that I'm reinstated as of 4 days ago. It was that quick and with your doctors saying you can't work I imagine your case would also be quick. Even though our income is HORRIBLY low I am glad that I gave the lawyer $68.00 last month and will this one to get this straightened out. Good luck.
