View Full Version : W/C Denial & personal insurance

My problem is I got hurt at work over a year ago and w/c keeps denying the surgery. Can I have my personal insurance pay for the surgery since w/c denied it for over a year. then if w//c is told to pay in court they can pay the personal insurance back? I can not continue with this pain while w/c plays their games. It is my life they are messing with and maybe even permanant nerve damage.

Hasn't anyone ever had this problem. Would personal insurance pay or would I be stuck with the bill?

Hello Terri43,
Sorry to see you going through so much crap from WC and no they dont care that your suffering they just want you to give up and say just forget it.
WC is such a joke I have been dealing with them since 2002. What happened with most of my dr bills or things that I need done like physical therapy is they first sent the bill to WC and of course they deny it then they would send it a second time and then if they denied it again they would send it to my insurance company. Then my insurance would pay for it then they would have to get the money back when we went to court in which they always did get it back.
But did you know that once your dr or hospital takes you as a WC patient that if WC or your insurance doesnt pay. That you are not responsible for the bill. The hospital or drs office just has to bite the bill. And if they start to harrase you about the bills your attorney can send them a letter to that effect and to stop harrassing you.
Anyway hope this helps alittle

Thanks Kathy, I am going to talk to my lawyer about this and maybe we can go that route. I just want to get better so I can get back to work. I really really loved my job and want to go back to it.

i hope things go good for you. Just remember WC is a big pain. No matter what you do they will deny you. We settled on my back pay and my drs rating and mileage in July but they havent even got the paper work to the drs for the settlement now we have to go to court again because they have been taking too long. So the judge wants to know why? I hope he fines them again they would deserve it.

Well I called my personal insurance and they said that if I had proof that w/c has denied treatment then I can use my personal insurance to get treatment. They don't have pre exisiting on our policy. And I'm lucky that both my doctors that I have been seeing for my neck and back problem are in my network. And I called my lawyer and he said that I could go ahead and do that but I have to first go to the state appointed neurosurgeon and maybe he will agree with the 5 other doctors and they will have to pay. either way i'm going to get fix and I am starting to see the light at the end of the tunnel. I hope to get back to work as soon a I can. Not at the place that is screwing me over. Thats ok I know some of their secrets..The state might like to know about. I really loved my job and they know I got hurt on the job but they want to fight me. Well I love those old people in this nursing home and I don't like the treatment they get. end of story. I loved all those elderly people as if they were my grandparents. I would got to thrift stores and buy them clothing because what they had didn't fit or they only had 1 outfit. I would buy fixadent for the people that would lose their dentures because they would fall out. I didn't know that the supply room stocked it. Nobody ever used it on their residents. The little things like sittiing and praying with someone that knows they are dying. or brushing their hair. thiings that the employees were paid to do but didn't think it was important enough. Sorry for the ranting but w/c insurance really stinks and my employer should be on my side but they aren't so I just spend all my time thinking about how these elderly residents are doing. Some of them have called me their angel, well maybe in a way I am :angel: I miss them so much

Hi Terri,

The answer is yes, you can have your insurance company pay for the surgery for now and WC will reimburse them once you win your case. If the insurance company is aware it is a WC claim pending they will be hesitant to pay, so I would not make a big deal of it in your attempt to initially get them to pay for surgery.

However, as to a hospital not being able to collect a bill from you if WC and your insurance does not pay, you may want to check into the laws of your state. I am an attorney dealing with WC everyday and I am certain that is not the case in any states we deal with.
