Can someone who is taking money out of an elder's checking account (her name is on it too) without the elder's knowledge or permission be considered a form of elder abuse?

My dad has alzheimer's and has no understanding of finances. My sister is taking total advantage of him. I'm going to talk to a lawyer tomorrow but I was hoping someone could shed some light on the subject for me.

hi barb,
i've been through this before. i was in your same situation, only it was my brother. i contacted the adult protective services (aps) in my area. you will have one in your area as well. do a web search for elder abuse. they will send out an aps officer and take a report. unfortunately, because your sister (and my brother) are signers on the account their is nothing the police can do, i called them as well. but, aps may be able to help.

Wow! I am really glad you are doing something to protect your father. I don't know the term for it, but that's certainly illegal.

It is really terrible but people in the same family will take advantage of a person when they do not have all their facilities. It is like they forget that this is a parent and all they can think of is the money factor. Even if caught they offer no sorrow for what they did. They are not even sorry they were caught. They feel like they deserved it and will turn everything around so much that at the end they have convinced themselves that what they did was right.

It is something how an individual for money can do just about anything under the right circumstances. Pretty sick.

Bosmom, Does your sister have power of attorney? I would certainly check into that!!
