Check the Social Security web site. Some states have caps. Mine does.

The cap in my state is $5300 which SS pays right off the top.

Social Security attorney fees are strictly regulated by the Social Security Administration. No attorney fees can be charged unless you win your case. Fees are limited to 25% of the back benefits to a maximum of $5,300.00, whichever is less.

I'm glad you replied to this thread. I need to ask you if I was an idiot like I think I might have been. I was under the impression that I would only owe up to a max of 5 grand no matter what. But I signed a contract that I'm kind of wondering about now. They sent me a copy of the contract I signed after I got the fully favorable letter. Here's the paragraph verbatim.

"Upon the execution of this fee contract, I agree that it be made a part of a petition to obtain approval of a fee filed by (attorneys name) upon the successful conclusion of my case. I , therefore, authorize and request that the Social Security Administration pay directly to (attorneys name), from any back Social Security benefits due me and my dependents, if any, the sum of 25% of such back benefits, whether or not the total sum of 25% is over and above the approval limit of an Administrative Law Judge or other agency of the Social Security Administration. Should 25% of my back benefits amount to less than 1000.00 dollars, I agree to make arrangements to pay the difference to (attorneys name).

The part that worries me is the whether or not the total sum of 25% is over and above the approval limit of an Administrative Law Judge.... yada yada yada....

They sent me a letter advising me not to cash my back benefits until I had contacted them so they could make sure the amounts were correct. I'm afraid that means they want 25% if it is over the 5 grand. Boy, I guess I'm in for it.

The fee limitations are set by SSA and no private attorney has the authority to charge otherwise, no matter what their fee agreement might say. If any attorney attempts to collect attorney fees in excess of the $5,300.00 cap, they should be reported to SSA as well as your state and local bar associations. Neither can an attorney charge more than the 25% of the back benefits (capped at $5,300.00) even if the back benefits are less than $1,000.00 or any lower amount. In any case, no payment should be made beyond that which is allowed by SSA, period, end of story.

Thanks Purplebill. I had no reason to think my attorney was less than honorable, I suppose I made a bad assumption, something I honestly try not to do. Again, thank you for the info.
