Been a while since i've been here, little background, hubby had cervical fusion 2002 and again 2 yrs later, cause didn't take, on social security, and work comp all this time, now comp wants to stop, not settled from beginning, attorney appealing, he has rec'd small amt from SS, how long from time contact SS to rec full amt of
ss since has been reduced due to wc pymt?

any input would be appreciated.

Once the WC is discontinued his full benefits should be restored within a few months time. When you do contact the social security office be sure to ask them the same question and follow up at a later time if his benefits have not been increased in the time indicated.
If the WC is appealed and yo do win your husband may be required to backpack Social Security any money that has been over paid.

Just getting to that point-3 years of comp denying, then 6 months later pays, this happens on just about every step I take. Ever heard of a slam dunk-I fell 12 feet-landing on my tailbone. Doesn't take a genius to figure this out RIGHT? Only in America where insurance companies tell doctors and patients way they can do.

Lawyer says you can not collect both ss dis. and comp. If you settle comp-subtract the ss from comp = what you get. I have not received anything for over 2 years for temp or permanent disability. Long story, but work comp will hang on to their money as long as they can. Then they cancel out of the last two trial dates, claiming they were not ready.... God I am tried of comp,BUT I WILL NEVER BACK DOWN AND GIVE IN TO THOSE LYING S.O.B'S

It works the same way with long term disability as well only in reverse however. You get your full SSD and if the amount you would of got from LTD was more you'd get the difference of the two. It is how the system works and it is in place for a reason. You can not double collect disability.

I understand the complaint about not getting enough to live off of on SS but do you realize that people on Disability often get more money than people who retire after many years of work? Those who really should complain are those who work for 45 or more years and get half of what a person gets on SSD.

If I worked for 45 years I would be getting more than $800.00 a month because I put money into my 401k plus my retirement ect...ect.. I have labored since I was 15 just purchased a house ( without dissability insurance ) and have 1 daughter in college and one 15yr old . Now it's not my fault that I can't work I didn't plan on my injury And I really hate that remark about those who should complain are the people who worked for 45 or more years . That would be there on faults for making less money , plus If I could work I would be working , I loved my job and friends . But I'm not on SS so I'll stop there. You really shouldn't come off saying that stuff here where people are dealing with SS .

I think you misunderstood what I'm trying to say.

SS payments at retirement are not based in the same method that SSD payments are based. Oftentimes people on SSD can earn more money than those on regular social security retirement who were able to spend their lives working.

While I will not tell you how much I get on SSD I can tell you I have only worked for around 10 years and my father on the other hand worked and paid into SS since age 16 and retired at 65 with a very good salary. I receive double of what he gets on Social Security (without dependants) and nearly 3 times that of what my friend recieves who is in her 70's and continues to work. That was my point in which you misunderstood.

I am not reffering to those who have 401k's or anything else, I am reffering to Social Security payments alone. SSD is based on what you paid in in your most recent quarters and not what you paid into it through the years. They take your highest quarters, standard SS does not do this.

I have been dealing with SS for many years because I was born disabled. I am fully aware of how the system works. Drop by the Disability board anytime as there's an individual there who actually works for Social Security and he'll give you the skinny on it.

No one plans on being disabled or wants to be disabled let alone have to deal with the way SS works at best.

Found this site looking for an answer as to how long the recovery period for a fusion is.The SSD and LTD are important to me as I am close to retirement.

I work as a lineman for a power company,and was injured in a fall while working in a snow storm in Jan of 01.The fall resulted in two knee surgerys.During the recovery period I complained to the OS about lower back pain,he kept telling me that it was due to my limping from the knee syrgery.I finally got tired of it and went to a neurosurgeon,who sent me in for a disco gram.To make a long story short I am looking at a fusion and a knee replacement.

This is covered by workers comp,but I have enough vacation and sick leave to carry me a year at full pay,then I will apply for SSD and my long term
disability which I pay for at work. Called SS and they said that my SSD will not be reduced or off-set by my LTD because it is a private plan that I pay for.

Once you get surgery through comp you don't get nothing else,they want to get you back to work,that is their game.So you practically force to take the surgery to keep a check coming,but what about continuing your meds if you don't do surgery at this time?Or need pain management for a treatment,I have no insurance,and I was born in America.
