View Full Version : Worker Comp Wanting Me To Settle ?

Hi ,
Guess I should stste my problems before I ask for suggestion , In 2003 I injured my spine at work , I have traumatic spondylolisthesis from lifting alot. I actually felt my spine snap the day it broke. I had a Laminectomy and fusion of the L4-L5 with hardware in 2004 in 2005 during therapy I broke a screw that holds my hardware in place so I had more surgery so recently workers comp ask my lawyer If I was ready to settle. I told my attorney that I was having way to much trouble to be settleing just yet. I just had scar tissue and more bone added to my spine this past July . My attorney said what about a loss wage settlement ? I told him no ! Unless it was really a good amount. We decided on a pretty good amount that would pay off my home and vehicle plus help my wife finish up her college . Well my attorney called and said that w/c wants to settle everything and how much would it take ? I told him a large amount. We decided on how much , and it's very large with 2 years left on my medical. I havent heard anything for 2 months , not even a no. I'm not excited for it , I'm actually scared because I know I will be needing another surgery by next year.

Does anyone know how much I should ask ,or know of anyone who settled a back injury. My price may be less than I should get. I can't work due to my injury , it hurts just to sit around yet do any walking. I'm not ready for SSD I would love to run my own little buisness ,but need a boast with income , I don't want to just give my injury away. Any Idea's ?

Oopps..sorry that didn't come off right , what I meant is I can't work at what I used to and if I could start my own buisness I could work at my pace , If I was hurting I could go home and relax . I would tell myself when to stop..And I wouldn't have to worry about getting fired . Can you understand where I'm comming from ? I know somwhere down that road I'll need SSD , and I would like to build it up cause I don't believe I could live on SSD right now. The pay just isn't enough to support my family. And if I were to settle while on SSD they would take a good chunk of it.

shawley----- whatever you settle on is between you and your attorney. all cases are different. all states are different. A large sum as you say and medical for two years doesn't sound bad. when my husband settled his attoreny told him this was the last offer from the IC. he took it with medical for life. when an attorney that you trust and has worked hard for you for years tells you times up I tend to believe them. If you go in with a high expectation it leaves room for the IC to counteract and then your attorney to do the same. ususally you meet somewhere in the middle of what you expect and what they'll give. Best of luck. I hope everything works out to your benefit. mainly your health.

ICC , thanks , my attorney thinks I should get a good amount , personally I wanted more. I have insurance through my wife if my back problems get worse. I just want to move on with my life but I'm scared I won't be able to do it. My idea is to purchase a small dump truck and a backhoe and do small jobs. I understand I won't get rich ,but I love being outdoors and if I could do this for a couple hours and quit when I hurt would make me feel better about myself.

To get half of what I ask for wouldn't do . I was privlaged to work for my company for 12 years and I thank them for that , but because they tried to cut cost to save the company money I was injured . Who is going to take care of me financially. My attorney figured out how much I should get and has ask for it , but we haven't heard anything from them yet ?

shawley---you have to do what's best for you. i understand the dump truck and backhoe as my husband is a disabled bricklayer, concrete finisher. it's something you can teach others how to do the work and you supervise . that will keep you safe from re-injuring. please, please check with your attorney. to my understanding once you settle a WC no other insurance will pay for anything regarding the injury since they expect your settlement to cover you.

ICC yes I understand after a full and complete settlement they will no longer be reliable for my injury , BUT If I'm at maximum medical do they still have to pay my med down the road ? My attorney is telling me w/c can try to have my medical dropped because I'm at MMI ? I wouldn't think so because I have hardware and 'm having a time of my life fusing..Maybe he just wants me to settle so he gets some money I don't know ?

shawley i'm sure you know what MMI means at this point. it depends on the case, the attorneys, the IC alot of things. My husband will get no better than what he is. he doesn't go to therapy anymore or take any meds. he knows he's as good as he's going to get. His medial was left open for life 1st because the IC can give him a lesser amount and 2nd who knows if he'll need another surgery down the road. his attorney told him at any point my husband or the IC can opt to closehis medical with my husband receiving a part of what they put aside for future medical but he will not receive it all.

don't settle. You are still treating. One operation can cost 200,000 that iwll come out of your pocket once WC stops your medical. Instead you can collect your wc check for life. I will never settle. My medical bills are still too high and I am still treating with my back 10 years later. just had two surgeries that cost 100k each. I would have been screwed had I not had WC pay for them.

apply now for SSD. It could take 3 years for you to get it. Once you get it you can always earn up to a certain amount at your own business...forget what that is.

Also---you can't come and go as you please in your own business. Customers will expect you to be there. Unless you are doing some sort of work that you can take as you want (like a handy man business) or something. But if you are going to open a store you can't close up shop when you don't feel good or you will lose customers.

Seriously apply for SSD now.

I heard you can risk loosing wc benifits by applying for ssd? Is there any truth to that? I would think it would be kinda silly to wait until wc benifits stop then apply for ssd..I am not sure what to do...or when to do it.. I just wish I knew how all this is going to play out (my situation). I havent heard anything about settling yet. At what point do I turn the atty. loose?

Be careful with any back surgery, a friend had a similar problem. He got an infection and the Surgeon did not tell him or did not know. The Surgeon was "let go" from Hartford Hospital in CT and moved to a small hospital way out in the woods where people in town know how bad the little hospital is and would not go there unless it was for testing only. Careful of infections!
