Dear board buddies, i am wondering if you are in a disability appeal process and you get a job part time will they automatically say you are not disabled and cancel your appeal? I called my worker and she said no they won't but someone posted on the thread somewhere that that had happened to them. Any suggestion please? I am gonna call the main office today and ask them also, maybe they know more about it than my worker, or who else would i call?

I am in appeals and currently waiting for an ALJ date. I got an offer of some work prior to Xmas and also got interested in mystery shopping. Most people think it's a scam but I make a little cash off the mystery shopping. The seasonal work was merchandising, mostly just making sure displays of specific Xmas gift items stayed neat and stocked.

I called and asked if I could try to work while the appeal was going. I was told I could but to be sure and let the ALJ know. So I wrote a letter explaining about the merchandising and all, named companies I was contracting under and gave estimates on the amount of work/income I would be able to do. For 3 months worth of work last year my profit was about $500 and that is nowhere near the amount you are allowed to earn during a trial work period.

I have added more companies and some were only seasonal so I plan to write another letter, basically an update, and hand deliver it to the hearings office. I always make 2 copies and ask them to stamp the 2nd so I can prove it was delivered and when. the amount of work I am doing is very little time wise and very easy. The judge will take it into consideration but they also have to take into consideration any changes you make in order to do the work. For ex, I take muscle relaxers daily and have narcotic as well to take when needed.

tweiler , thanks for letting me know whats going on. I called the main office and asked them at the toll free number and they said of course you can try to work partime, people need to survive somehow in the meantime, and that i just need to report my earning if i work. I have to have my thyroid removed on Feb. 5th and then after i recover my work is gonna let me come back partime or less depending on what i can do at that time and i'm glad you mentioned writting the letter thats what i will do also as well as let my worker know. I also have to take pain relievers and muscle relaxers daily also, and i'm not even sure if i will be able to work, but really want to try. I was supposed to see the back surgeon yesterday but they couldn't see me because they didn't have my psychical therapy report so i had to reschedule. They tried to call but had the wrong number ugh.
