Rose, you are so right about getting stuck with half the bills. My lawyer said I am responsible for half the credit card debt that is now over 50,000 and mounting everyday. I do not think its fair since most of it is for bars, restaurants and untangible things. However, the lawyer said the judge may consider many things first so we will see. I cannot believe a person can spend so much money so fast and why credit company's give such a high credit limit. He pays 1200 a month on them and I bet it is mostly interest. Makes me nauseous. How are you?


YIKES, that's quite a bill! :eek: Get out before he gets them up to 100 grand.....
My ex ran them up gambling on the riverboats when I thought he was at work....:rolleyes: Yeah it's mind-boggling how they can go thru money like it's water and the meter will keep ticking the longer you're there.
See what your lawyer suggests, regarding your responsibility and if there is anyway she can pull some strings with the judge. There may be a way to use leverage. Do either of you have 401K's? That's considered marital property, and he was trying to take 1/2 of mine. It was negotiated on and he didn't get it, but he got his part out of something else. Ask your lawyer what all your options are and what is your best bet.

I am self employed so I do not have 401 but he does. My lawyer is trying to figure out something. She wants copies of the CC transactions. He is paying over 1200 a month on them it seems he could of spend that and not run up CC. He must of been manic because he went from 20,000 to over 50,000 really really fast but all on nothing. ok so he has a 401K, by law you are entitled to 1/2 of that......here's where your leverage comes in......let him keep his 401 K, but you're not willing to pay any of his credit card debt......if he protests...ok, you want your share of his 401K......use that to pay the debt. Mention this to the lawyer, I bet it won't come to that because cashing in a 401k is not usually the best way, too many penalties...he would probably be happy to keep the 401K (unless it's small), then he may fight because he's rather have you pay off his credit card debt. There are lots of ways to "negotiate", see what your lawyer says.
I realize without knowing the value of the 401 K, it's hard to compare apples to apples. If it's only 5000, me may be happy to give you 1/2, while sticking you with the outrageous credit card debt. Don't agree to anything you're not comfortable with, and you don't have to agree on anything.....if you don't agree, it will go to court and the judge will decide. Don't give in and take the short end of the stick marshmallow.....you've had the short end of the stick for too long now!

My lawyer mentioned that and she said it may have to go to court.The one thing I am so happy about is my house is mine. Everything you had before the marriage is your and the house was mine. I never put him on the deed or title whatever it is called. He wanted me to put his name on it and thank God something told me NO.


That's the best thing you ever did/didn't do :angel:

make sure that house is yours! some states have community property laws, or no-fault laws or something like that.....what state are you in?

My lawyer said the house is mine. Anything we come into the marriage with we can keep but all marital propery is divided including bills. So she said no problem there.
