Hello, i have been recieving Long Term Disability for 2 years this month and i have a Long Term Disability lawyer for to take my case for getting my LTD for longer due to a cyst on my spine that i need surgery to have it taken out.
He is getting all my doctors infomation and will get back in touch with me.
What i need to know is how long does it usually take to get this over with? I am getting worried because this month is suppose to be the last month i get my check. My lawyer is aware of my situation.Thanks so much !! Karen

I don't understand? Are you referring to Social Security Disability or LTD through your employer? I'm on SSD and have been for over four years and they didn't give me an end date and as far as I know they don't do that for anyone. When I went on SSD, they did tell me my case might be reviewed in 5-7 years. I start my fifth year in March, 2008.

Okay, that explains things a little better. I too, had disability through my employer and it ended at 24 months, just like yours did. I was drawing a minimum payment from mine, as I was receiving Social Security Disability too. I had been approved for both, but took the SSD because it was over $300 more a month than the benefit from my employer.
I'm starting to realize that this must be a fairly standard clause in these disability claims. When I first started with it, I didn't have a clue that LTD meant 24 months! To me, that's not long term!!
I guess the only thing I could tell you is to apply for SSD like I did and see if you can gain approval for that. Their monthly benefits are roughly what your maximum Social Security would be if you were retiring at age 65 (or 66 for most now). There is a five month waiting period, so you should have applied several months ago, assuming you haven't.

Director, I did apply for SSD 2 times and they denied me so since my LTD is suppose to be over this month on the 15th i needed to get a LTD lawyer. I called him the 3rd of this month and he is getting a adavdavid( not spelled right ) to get my doctors to sign it saying i am not able to work due to having this cyst on my spine.
Then i guess it goes before the judge and see what he says. So we are sueing the LTD insurance company for letting my health problem get so bad and to extend my LTD or to get money for my pain and suffering all this time.. I need surgery to remove this cyst and i don't have any health insurance.

Could your attorney also pursue your claim with SSD? Some cases take two or three years to reach a favorable conclusion. If you just let the original claim expire or whatever they call it, your attorney could file a new claim for you and go after both claims at the same time. This is what I did, in the beginning I applied for both and was approved for both. In other words they both found in my favor and as I said earlier, I chose the Social Security claim because the monthly check was higher.
Talk to your lawyer and see what he says about filing both claims.
