I have a question I am hoping someone might be able to answer. I applied for ssi disability in 05 and was turned down. Since then I have appealed it and should get a letter for a hearing date anytime. My question is... I know when you get ssi they take your husbands income into consideration when making their desicion. But, what if we have been seperated for 21 months~ He has helped with bills but we have not been together for nearly 2 years. Does anyone know how they base if you are eligible or not if you are married but seperated? Kathy

I know that in Alabama disability is not based on your husband's income. That was one of the first questions that I asked. I was told that it is based on the income that I made while working 28 years. I hope this helps.

hey unique,that is only with actual disability which IS based on years worked only.ssi is a completely different thing that IS based on income along with having a disability that actually qualifys you.

my best advice for you kathy is to just call the main office number and ask.i would think because you leagally are still married it could still be considered.but i don't know for certain.the best info would come from them.i am sure they could tell you right over the phone.good luck,marcia

I don't think she's asking about SSD. She wrote SSI, which is a welfare program that is means based.

I think it depends on whether your husband is actually living in the same residence with you. If you call your DO (if you can get 'em on the phone, that is), they can tell you for sure.

I honestly thought she was talking about her being denied for SSI disability. She is waiting for an appeal and I thought she wondered if her husband's income would be considered for disabilty... Sorry about giving a wrong answer. Apparently I misread the question.

Maybe not. Maybe it's me. The subject line says "SSI" so it's unclear to me whether she's talking about SSI or SSD. I mean, why would her spouse's income count against SSD?

Re: SSI. I'm thinking her spouse's income could make her ineligible if SS thinks he lives in the home. I've heard of people being disqualified because their more distant relatives living in the home got welfare or some other small income.
