My husband has just been denied for the second time for social security disability. We have an appointment with a lawyer tomorrow afternoon.
The lawyer said he keeps being denied because of his age. He is only 34 but he hasn't worked in over 2 years and he can't work. He has never been able to keep a job over 6 months. He has physical and mental problems.
He has severe scoliosis, his back looks like a snake in an 'S' shape and his neck doesn't have the natural curve that it should. He was injured on the job about 5 years ago and ruptured a disk between his 6th and 7th veterbrae, and at the time his neurologist and orthopedic specialist said it was the worst rupture they had seen in a while, the ruptured disk was pushing in on his spinal cord, they said he was lucky it didn't sever his spinal cord and paralyze him. Well he received a partial permanent disability rating of 32%. He also has severe gout in his feet and now spreading to his knees, an outbreak of gout leaves him bedridden for days if not weeks like the last outbreak, he also has bipolar, ADHD, depression, he is dyslexic and has high blood pressure.
The lawyer says when social security looks at his case they see his young age and that he can be retrained to do a desk job but even sitting for long periods of time hurt his neck because of his neck problems and his back because of his scoliosis. The lawyer asked if a medical doctor can say that yes he has scoliosis that we may have a chance. Before my husband told him he had scoliosis and that yes he could get proof from a medical doctor that he does have it, we may have a chance.
What are the odds or the chances that he can get approved based on his disabilities and age?
We live in Oklahoma.
Has anyone ever had problems getting SSI because of their age, being too young supposedly?
Please any advice is so greatly appreciated right now.
He hasnt' worked in over 2 years and the lawyer asked are you sure you can't work and my husband said yes.
I'm taking it that the lawyer would have taken the case if he didn't think he could win it. He did say it was going to be tough fight. We'll appeal as many times as it takes though and if this lawyer can't get it done we'll go to another one.

Also social security wanted to see that my husband was getting current treatments for his disabilities but we are not rich by any means and do not have medical insurance and can't afford a $70+ doctors per visit not including hundreds of dollars of prescriptions a month.

hi hamilton,
ssdi dont put so much on the diease as they put on 'how that diease keeps you from doing ANY job.
find yourself a low cost/no cost clinic your husband can go to..also wal mart has a 4.00 plan on meds..I went and picked one up and gave it to my doc who perscribe's me meds on that list..if it wasnt for that I could not aford the med. I also go to a low cost clinic the doc visits are based on my husbands income.
If anything it will show that your husband is continueing to seek medical attention in hopes of finding relief or a cure. also make sure you get his meds. I am sure the meds he takes causes all kinds of side effects.

make sure you list all his symptoms and side effects of the meds he is taking and how they effect him on a daily bases..alot of folks do a personal health jornal (make sure this jornal go's to court with your lawyer) letters from bosses and family memebers conserning your husbands health probs over the years help in the process alot. oh, and also if you can get a doc for your husband see if you can get a rfc form and have his doc fill it out then give it to your lawyer for your husbands files. last but not least get all of your husbands med records an continue seeing a doc for more records to go in your husbands files..the more the merrier. gl :D

Have you had any Doctors actually write him off as totally disabled? it only takes one Doctor, but the SSA comes up with 2 Doctors to override one Doctor. It should NOT be that way but sadly it is.:(

Dire need gets the approval as does, patient documentation, test, meds,
a dependant under 18 at home, gets the approval, homeless, starving.:(

Sad that its that way (( why cant the ill and disabled get the funds they need? its not like we are having a party being sick.
we are not having a good time.:(

Ive applied 3 times for SSD turned down 3 times, my Doctor did paperwork for my disability he declared me as disabled but their Doctors felt I could work, they pull jobs out of their hat. My file is 4 inches thick. Ive went to the same Dr for 30 year and others for second opinions Neurologist mainly.

I applied again and I have a lawyer waiting I will appeal if I get turned down again, Im 50 Ive heard of people getting approved at a young age it can happen.

I got disability in Arkansas the first filing, I was 39 at the time. I had worked 2-3 jobs since age 15 living on my own at that age and wore my body out and then had a crash in a police car which has resulted in 28 surgeries. I did not use an Attorney and I listed things I could do and would love to work, but medicinally I am a disaster. I have a friend that took 7 years to qualify but it was worth the wait. Some crititcal factors are if you worked the same type of job most of your life,me for instance, security military and then police officer, it was not likely I could be retrained to do anything else although I have an accounting background. prood of a deteriorating income is a factor, I think there were 5 criteria that had to be met, regardless of age. So do no give up and God Bless

I'm 42 and was denied. I worked for 22 years. I applied because I had spinal fusion with instrumentation and are in a lot of pain. Sept will be a year. Also have severe obstructive sleep apnea and Narcolepsy. Then I have hernitated discs in my neck with a pinched nerve. I have tendonititis in both elbows which I have a workman comp case on. I went to an atty the end of june. He said social security has 14 illnesses. If your illnesses don't fit nice and neat into the 14 then you are denied automatically. He said age is another reason. They deny you because they figure you are young and need the money so you will go out and work at any job and not appeal. I am lucky that i was able to get a pension with retirement and are just squeaking by. My atty said to be prepared to be denied two more times and I will get it when I go before a judge. He said probably 2 years. I'm hoping quicker. I just had another sleep study so maybe that will help. From what I understand is make sure your husband keeps going to specialist for follow ups. That is what they want to see. The atty told me he had a client who was disabled. He was getting diability and never went back to the doctor. So a few years passed and they took away from him because they assumed he was okay since he had not been to the dr in years. They are horrible. By coincidence today in the mail I got the paperwork SS sends every year saying how much you would get if disabled today and how many credits you have etc. I even had two doctors sign paperwork saying I was totally disabled. I needed it for my retirement disability. The atty said they probably didn't even look at the paperwork I sent. Hope your husband feels better. Keep hanging in there.

Hi Hamilton, What are the chances if you don't apply? My opinion is go for it. I see Cantell gave you alot of good info, it's always good to find and read information we never knew existed. Very good advice Cantell. There is help out there, we just need to ask. Hamilton my advice is appeal until you receive, stand for your rights. Best wishes.
