View Full Version : My lawyers messing up my case

He is the one who is delaying it. He doesn't even know who I am. He got my file mixed up with someone else's.
Yesterday the assistant called and told me to take my Favorable Decision award letter to the SS office for some reason. I got excited and said I had not yet received my letter. She looked at my files for a minute and then said how sorry she was, that the lawyer had messed my file up with someone else's and that all the SS office needs from me is my lawyer to call them back and they will give me an on the record decision if I agree to a certain date my disability started.
Oh man, all of my panic and depression got so bad when I found out I had not been approved like she first said.
I told her to put down that Yes I Agree with the time no matter when it is and to underline it and put stars by it and stick it in front of his face and for him to call them before it is too late.
I am going to call them twice every day until he does what a lawyer is suppose to do. He may be out of town until next wednesday which is making my panic soar.
I am very mad at them. Why did he take my case if he is so busy with so many other cases. It is too late to change now so I guess I will just have to wait and hope I don't end up in the mental hospital.

Hi Delta, I'm sorry to hear your lawyer messed up your case. I think you should see if you can't file some type of complaint against him with the state board that oversee lawyer misconduct. Because this is not acceptable for a lawyer. I'm with you if he had too many cases already then he shouldn't have taken on your case. There was a lawyer here where she had some many disability cases that they made her reduce the cases she could take on. I would see if there wasn't someone that I could complain to about the way he handle your case. His actions most definitely caused a delay in your case being heard.

Since my post the lawyer took care of what he was suppose to because I kept calling until they did.
What do you know about that :)
My sister told me to be more assertive because I am so shy so I did just what she said and I feel better about the whole darn thing.
Now it's more waiting but the time will go by.

I'm glad to hear that sometimes you just have to worried them to death to get them motivated. The bad thing is their like the IRS they're sure in a hurry to get that money. Your lawyer should be made to wait just like you before he gets paid.

I don't mean to sound skeptical, but as with all government agencies, I find it very hard to get anything done in an adequate time frame. I am wondering just how many deals such as yours are being made that moves up the date of disability for a quicker decision. That sounds as if they are bargaining to avoid paying a large backpayment and it makes me question whether a person would get that favorable decision if they declined. I realize that a lot of us will take anything after such a long wait, but I can't help but wonder how often this tactic is used and how many have waived large backpayments just to get a monthly award. Seems nothing is fair about the way the disabled have to fight for their day in court. Okay I feel better!
