My hubby was told when he hired them that there was a cap on the benefits{5400.00}that would be paid to the attorney if he won my hubby's case. Well back in January of this year they won and today we get a letter stating that
social security disability would be taking 25% of his backpay for the attorney
fees. So is it 5400.00 or 25%? He will be getting a substantial amount of back pay and I am just curious. Any answers would be appreciated.

hello racing nanny.. my understanding is 25% UP TO $5300. They are allowed to bill you for making copies, postage and other things they do for your case. I'm still waiting for my hearing date, but based on what my congressman told me this week....it will be any day to get a date. Woo hooo!

mine was 25% too...
or up to 5300.00..
i dont know how much back pay you are getting, but the most he can get is 5300, or 5400. which ever the correct amount is.
which is okay if your getting thousands back in my case i only had a couple months of back pay so i think all he is getting is like 620.00
So it depends on how much your getting back, of course he cant get 5300. from me because im not getting that much.
