I cannot beleive it, the children were added to my husbands claim via a phone interview a couple days ago. They were added to the original claim but denied because ssa said that my husband didnt provide over 1/2 the support. We challanged thatand then the case worker added the children. But he said that he didnt want to open the case of the children until we started getting regular monthly ssdi check so the payments were not screwed up. Since we have not had any income until the ssdi approval, the ssa case worker asked how we have been living buying food etc. We told him my mother in law has helped by paying some bills until we start getting the ssdi monthly checks. So now ssa says that the children are eligable just from the phone interveiw a couple days ago and no backpay. THE REASON because his mother helped us with food. can you believe that? What do i do has anyone heard of such a thing?:mad:

This sounds kind of fishy to me. I would see if someone else posts and can maybe direct you on who to contact.--Maybe your state rep?

I called the case worker back, I was angry. I cant believe that he says the help from my in law was a form of child support. I told him that the money she had spent needed to be paid back!!! So we will see what happen I hope I dont have to appeal this desion. If he had just added the girls in the beginning I would not have needed to get the help, he was the one who said to wait. This sysytem is so messed up.

Hi Jean,

Something is definitely wrong here. If you were receiving SSI, and NOT SSD if may make a difference, but SSDI oeprats entirely different. I would either speak to a supervisor, or go to the SSA office and speak to someone in authority!!!! Your kids are entitled t backpay, just as much, and the checks are separate checks no lumped up together. I would urge you to do this ASAP. You may have been speaking to a rookie who doesn't know the ropes, and certainly doesn't know the difference between SSI, and SSDI.

Hi Jean.... I may have a ray of hope for you..... I as well borrowed money while awaiting my SS. My lawyer right away asked that I get a letter from my family that I borrowed from stating that the money I borrowed would have to be paid back as soon as I received my backpay. They had to sign it as well as me. I had no problem with this and received my child's entire backpay. I hope this will work out for you as well..........take-care, :angel:

Hi anyone. I have a simular question.What happens if my two children have been on financial assistence while Ive been awaiting my case to be decided will they be able to recieve payment should I get approved.
