I have not gotten the letter saying just how much I will get yet, however my lawyer figured it out in a very rough amount.
I keep seeing people post that there back pay was broken up in several payments. Is this ALWAYS the case?
My case is a closed period so no other payments will be sent.
I really need the whole thing.

If you will be collecting SSDI, then No.
If you are going to be collecting SSI then your backpay payments will be broken up in three payments, six months apart.

Can you tell me how I would know that? I know it sounds crazy but I have no idea if it is ssi or ssdi.

Ok I figured it out, it is SSDI. Now I have another question (sorry).
I have 2 kids, will they get some sort of back pay also because this is a closed period and no ongoing benefits apply.

From what I can find it looks like your children may very well receive benefits along with yours. Check out this page at SSA.gov.

I would imagine you need to make sure that SSA has your children's info in order to calculate the right payment.

Yes, your children are entitled to backpay benefits as well, and you will receive their portion going as far back as yours. They receive 1/2 of what your benefits are, not each of them, but the sum total of 1/2. Hope this makes sense.

I'm not sure how much of this your attorney is expected to have done for you, but I think I can offer a few points on your other questions about the SSI.
If your income and resources met the SSI eligibility requirements during your period of disability then this can be a benefit to you a couple different ways.
1)If your SSDI benefit was less than the Federal Benefit Rate (FBR for an individual ranged from $552 in 2003 to $603 in 2006) then SSI may increase the back payments coming to you.
2) Even if your SSDI is greater than the FBR you may still qualify for SSI if your income and resources met the eligibility requirements during your period of disability. While this won't net you any more "cash," it could still be a great help since SSI eligibles typically also qualify for their state's Medicaid. If you have outstanding medical bills from your disability period, it would probably be worth your time to provide the SSA with your financial and household information since some of this may be covered retroactively by Medicaid.

I just wanted to add this, Your kids will not collect from your SSI, only from your SSDI. But I know a girl who lives in NY who was collecting SSI only for a closed peroid, and she went to the welfare office and collected a welfare check for her son for that peroid. Welfare checks are not counted as income if collecting SSI. Also, She got all of her SSI pack pay. My understanding is if you are getting less than 4k in ssi back pay, they will pay it all to you in 1 lump sum.
NY is an VERY prograssive state, I often say "NY is the exception not the rule"

Ohhh I had no idea, hope I dont get in trouble. After reading AL of the 20 pages and not just skimming them it looks like I was not meeting the SGA for the back dates I was approved. It also seems I was denied my TWP of 9 months I was expecting :(
That will cut my back pay nearly in half (a good reason to not spend whats not in hand).
So now my question is this: If I didnt meet the SGA why was I approved for BOTH SSI & SSDI? It makes no sense if I didnt meet the SGA at all in that time frame.

I can't be sure, since I'm not reading the actual letter from SSA, but my suspicion is that there's just a misunderstanding because of the strange lingo they tend to use in these letters.
I suspect (but please realize I don't know) that when they say you "didn't meet SGA," that could be SSA speak for "you were working at less than the SGA level," which could be another way of saying that they did consider you disabled during those months.
Like I said, I don't have any way of knowing for sure, but I suspect a simple misunderstanding of the letter because of the not-so-simple way that they word things.:)

I am not sure if it will help but I am going to go into the local office today with my papers. I am betting they will still not give me the IMPORTANT info such as payment info but its worth going to get some of this cleared up.
