I think it may be legal in the USA, but it might be a state-to-state thing. I do know that an acquaintance of my mother's was prescribed it during chemotherapy (we're in Massachusetts) but unfortunately it didn't work all that well for her. I believe she ended up using regular marijuana for the nausea and vomiting, which did work well for her.
