View Full Version : Reconsideration or the Appeals Council which one better chance of winning?

My husband has been fighting for years now for his disability. He has his original claim with the appeals council and the new claim is in reconsideration. Which level has a better chance of wiinning at the appeals council or the reconsideration?

My original claim has been at the appeals council since Jan 2008. I have not heard one thing about it. So in Jan of 08 I also filed a new claim. I was awarded on new claim 6 months later. I don't no if I will ever hear from them over yr and half now. Good Luck

Sorry to hear you are having such a long wait with the appeals council. Thats an awful long time. Last time we heard from the lawyer that the appeals council requested more information. I dont know if thats good or not. That was about a month ago.

Just to answer your question, you have a better change of winning at the appeal stage. If you don't get approved at the reconderation stage, don't worry at that point, most people don't get approved at the reconderation stage.
