I am new to this site and I will try to make this short as possible. In 2004 I applied for SSI and SSD. I went through the whole process and in 2007 my claim went to the Appeals Council. My attorney told me to file a new claim in which I did and won on my first try. Just this year May of 2009 The Appeals Council overturned the AJL descision and found me disabled as of August of 2004. Now I am waiting on my backpay from then. I have had my interview with my local office in regards to SSI and still no backpay for my SSD. How long does this whole process usually take for the backpay from SSD show in your account. Also I am wondering since I received LTD for 2 years from 2005-06 and dec of 06 it stopped. Will LTD automatically come out of my backpay? At this time Im hoping not because my kids and I have been through so much even being homeless and I have bills and so many ohter things to take care of when this money comes. If you received Long Term Disability from an insurance company - the insurance company would have to ask you to pay them back for any period under which you received LTD. They can not get the funds directly from SS. Some insurance carriers do get reports of SS approvals so even if your claim has ended they could come back and ask you for some funds in return. But they most likely would not as your LTD claim with them is closed (if I'm reading your note right).

I just read your case. I to was denied with the ALj and my case has been at the appeals since Jan 08. I have not heard a thing. I since filed a new claimand won in aug of 08. I still have not heard from appeals council. How long did it take you after you were awarded 2nd time to hear from appeals council? thx

In my situation, once I got approved on my 2nd claim my local office never forwarded my pay status and approval over to the Appeals Council. Once that happened, it was a matter of a month before my attorney caled an told me that I was going to get backpay all the way to 2004. My 1st claim was at the Appeals council 18 months . I called them directly many times and was very persistant. Good luck

All I know about SSI and back pay is that it is paid in installments . Try calling Social Security , and asking them when your backpay installments are due to you. It might be an error if they do not have the correct address on you where you live? I am unsure though , because you should be reciving your monthly SSI checks by now. I hope this can all be sorted out. You should have recieved a letter stating the amounts of your backspay that is due to you, and when it is paid to you. Make certain you request this from Social Security.

Keep in mind that SSI and SSDI are two very different benefits so back-pay may be handled differently.

Well , I just decided not to go with the SSI part of my backpay. It wouldve only been 2 months worth anyway. Now I am waiting on the BIG backpay which is for 29 months. How long does that take to get ?
