I was wondering if anyone could give me some information concerning the statuatory rape laws for the U.S. (Michigan, particularly). My boyfriend's mother and her fiance keep insisting that he could get 25 years just for going out with me, and more if he got me pregnant, etc. He is 17 and I am 15, but there's exactly two and half years between us. They've been saying this for the past 8 months, and I would just like some information to convince them they're wrong so they'll get off of my case. They also were saying that if a police officer pulled us over and asked us our ages that my boyfriend could get arrested, now I know that's not true, but his parents need some convincing. I would really appreciate it,

If he has sex with you when he is 18 or older and you are younger than 18 (the age of consent in most states), then I believe he can be charged with statutory rape.

In some states, he doesn't even have to be 18 or over. I think you need to find out from a lawyer or someone in your state. I think it's odd that your bf's mom and fiance are having this conversation with you. I hope you get it straightened out.

I went ahead and looked it myself. Youre mother is right....you are underage. State law requires you to be 16 to able to consent to sex with him.
You might want to back off on the relationship just to make your mom happy and to keep your boyfriend out of jail.

Here is something from the site I listed above that if from your state.

The case in which four former students at Grosse Pointe North High School have been
ordered to stand trial on charges of criminal sexual conduct involving three underage
girls has revived the debate about statutory rape laws.

The girls say they were forced into sex or plied with liquor until they were too
incapacitated to object. There are some strange details in the case that cast doubt on
their stories. But whether or not they consented is legally irrelevant. The defendants are
charged with statutory rape, which requires only that the alleged victim
be over 12 and under 16. At the time of the incidents, the boys were 17 and 18 and the girls were 14.

Unlike some other states, Michigan does not set a minimum age for defendants or
require a minimum age gap between victim and defendant. Formally, the law does not
differentiate between a 30-year-old who has sex with a 13-year-old and a 19-year-old
who has sex with a 15-year-old.

I just wanted to clarify that this is not "my mother" that is saying this stuff, but his mother (my boyfriend's). Secondly, we are NOT SLEEPING TOGETHER, but his parents feel that we will, because they seem to find premarital relationships inevitable with young people (or for themselves). I'm strongly against premarital sex (no comments on that please), and I just wanted to go and shove some law in their face to prove to them that there is no way in hell that my boyfriend could go to jail for just dating me, much less for 25 years. Thank you, I just wanted to bring that out...

Just wait till have sex with him till your 18 then it won't really matter. As long as you don't do anything its ok.If you were 20 and he was 30 it wouldn't be saturtory rape becuz you are over 18. all that really matters to the law is if you are under 18 and datin someone 18 or over

In Michigan, A young man can be charged with statuatory rape at the age of 17. In Michigan, at 17 he is considered an adult. If he has sex..even oral it is considered statuatory rape; unless he gets her parents permission if she is 15 or younger. This happened to my son..he will now serve jail time and be on the sex offender registry for 25 years. You are putting your boyfriend in a very dangerous situation. If he even touches you without your parents consent this is sexual assault. Be careful and wait until you are 16 to go out with him.

I am a mi resident, and you must be 16 to be considered old enough. I also know that he still being 17 could get in trouble if sexual activity is considered to be going on. However, if a cop pulls you over and asks your age he can do nothing. He doesnt know your relationship to each other, and if you tell him, he still has no proof you are engaging in sexual activity. Just take things slow until you know your boyfriend will be safe.

Well, you're old enough to die for your country at 17 and up. These laws have a purpose, to protect immaturity that the law presumes most young people have. However, from the beginning of time, young people under 18 have been having romantic flings, sex etc.. Perhaps too it is the economic aspect, since that is the "engine" that fuels everything in America; perhaps, the likelihood that an underage female could get pregnant, and the guy and girl are not particularly prepared for the Labor Market has a lot to do with it.

I'm sure in less Industrialized Societies: India, Africa, China, etc., girls and boys under 18 are getting married and raising families.

This is all very interesting... I just wanted to add that here in Alabama, our statuatory rape laws are very leniant. The age of legal consent to sex or marriage is 16 across the board. However, you are not an adult (unless specially tried as an adult, emancipated, or married) until you are 19. This means the minimum age gap for statuatory rape is 15 to 19, which is a pretty reasonable one, I believe. I agree with this much. However, after the younger party is of the age of consent (16) the age of the older one doesn't matter one bit. a 16 yr. old girl can marry or sleep with a 40 yr old if she wanted to and noone gets in trouble. Does that last part seem a bit strange to you, or is it the same in other states?

I would be careful with this relationship, if his parants push the issue he could spend time in jail and be place on the sexual offends list for life, if convicted of even 4th degree csc( touching more or less) . To make it worries you could get married have kids the whole works and he would still be on the list.

In Michigan you are guilty till you prove yourself innocent, when it comes to sex laws.
Talk to an attorney to find out all the age requirements to stay out of trouble.

Would you like the advice of a police officer in California? Well...here ya go then. But this is in California though, so things might be different in Michigan. If for any reason your parents think that you guys are having sex then they can claim stat. rape on him. He could go to jail because it would just be your parents word against his. But as for being arrested for being with a guy that is 17 that is not likely. If he was 18 then the officer would simply call your parents to let them know where you are and make sure it was okay to be with him. Hope that clears some of it up for you. Good luck.
