HELP - Insurance company won't help, have bills and cannot work after accident

In my last post I told I was hit in the side at 50mph, the other dirver rana red light, company accepted liability, and settled on my vehicle, I sustained damage in diffren areas of my spine, especially cervical...I have BILLS ..payments, and I'm not working because I have not been released to go to work (probably disabled), the bills are due and I don't want to ruin credit, I asked for my lost wages and they wont give them, said they'll pay them when they pay the medical settlement 2 years down the road in one big lump sum... What can legealy be done to get me some money to pay these bills, I can't sit with them for 2 years, they are due now, and Im at the end of my line here...Someone needs to be paying something, and since I can't work, I'm sure by law they have to be giving me my lost wages or soemthing to pay the bills, I have NO OTHER source of $ except from my job, or any other outside help... ANYBODY BEEN DOWN THIS ROAD?

JD,
You said you have a lawyer on this, right? You do get reimbursed for lost wages but I am not sure how long that takes. I would be for callling your lawyer and ask him!!! My daugher was hit on a bike in a cross walk, she is 27 years old. Flew over the top of a van and landed on her head. She did get backpay for the time lost at work.

Different states have different requirements which is why i hate to give advice on Wc or Car Accidents.
I would check with the attorney, I know here in Ma. They have to pay up within 3 weeks, or get charged double! Something about your situation does not sound right. I think I would consult with another atty in Texas. If you are looking for an atty (mind you this is a truckers list, but the guy who runs the site may be able to help you out) check out http://www.truckerlawyers.com
I got my WC atty through them and have never been sorry!

Re: HELP - Insurance company won't help, have bills and cannot work after accident

Wish you were in my state. i have 7 Attorneys right up your alley in my family!
But I do know that when I had my car accident they had to pay within 2-3 weeks or it was doubled.
I know how it goes with Attys. they can take their ever-lovin time getting things done. I can see that with my WC case. I have been living on next to nothing for the last 3.5 years. If not for state aid, and the grace of my dad, my SO and I would be in subsidized housing. We had to sell the house 2 yars ago when we realized we just were not going to be able to handle all the bills.
Now the car payments are 2 months behind, and many other creditors are on a waiting list.
I would just be happy to get the checks reinstated, and have them pay the medicals. Medicare and Medicaid are paying for my medicals right now, waiting for reimbursement from the WC Provider.
Insurance companies do not care about those they have to pay. They are all out for themselves. And with the amount of fraudulent claims it is not hard to believe.
I actually had a tail put on me for several months about a year and half ago, trying to catch me doing things I was not supposed to. Be careful of that stuff. They do it all the time now. Anything to get out of paying you a dime.
I used to live in Texas, Dallas, to be exact. I know Texas is not a charm for WC, as it is not Mandatory for Employers to carry it. So I have to wonder about the laws surrounding payments from car accidents.
Keep me posted.
