median nerve completley severed during"routine" CTR

Was wondering if there is anyone out there, that has had any luck with med-mal??? My original ctr surgery resulted in my median nerve being completley severed. The worse pain i have ever experienced in the recovery room. Long story short....md went in a 2nd time and still could not or would not admit that the median nerve was severed....still with great pain....then i saw a hand specialsit or grafted a nerve from my ankle, but still have a continuing burning and numbness. I have consulted with 2 atty, and both came back with no potential expert witness's. This is so frustrating!!!! All i keep hearing is that it is considered a potential risk. A nick yes i would agree but a COMPLETE severance???? I just dont get it. PLEASE PLEASE anyone out there have any luck with med-mal????? This whole situation was wrong, and yet i have to live like this for the rest of my life! Disability said that i could possibly work as a parking lot attendant! how humiliating, besides, i have a left hand injury! in addition to all that ....i have had 2 cervial fusions within 3yrs eerrrr so frustrated !!

I'm sorry I can't be of much help in med mal. Surgeon nicked my nerve when doing CTR and that has been difficult to deal with, but you have had a complete cut. There must be attorneys somewhere that would take the case.
This is something I would consider as a reportable incident to your state medical licensing board. In my state, there is supposed to be a list, one can access, of medical mistakes, where they occurred and what doctor made them. If I were you, I'd look into that route as far as reporting the surgeon to the American Medical Association and your state's licensing board.
But again, I'm sorry not to be of more help in the med mal end of things. What happened to you should not have happened. It is so frustrating, in order to get the surgery in the first place, you have to sign a paper that basically signs your life away.
After I had had a second surgery to try to correct my problem, I called the first surgeon to tell him that he had done something wrong, even though he denied it. The second surgeon confirmed the nick. The original surgeon's response was to say that that is why the patient signs a release form.

You need to be aware that the statute of limitations for medical malpractice is different and often shorter then that of general negligence. Ie In New York the statute of limitations for general negligence is 3 years but is 2.5 years for med mal. I have never heard of an attorney rejecting a case because they could not find an expert witness especially pre-suit. So keep in mind that you are limited in terms of a time period and keep speaking with attorneys, someone will take your case. Good luck.

Get a lawyer, you can get disability. I didn't bother with med-mal but good luck.
