| Disability Question
I need some real help. I have filed for disability a yr ago. I have an attorney. It was denied and we filed an apeal. Well yesterday of course a Fri I got a letter in the mail from SSI saying that my attorney filed tardy and had no convincing evidence as to why so my request for a hearing has been denied. I was furious as I have been in phone contact with my case worker once a week. I have no idea why they filed tardy to begin with. I would have filed for myself. I called attorney who rudely told me he was gone until Mon. of course and that I would have to wait. I was crying and saying my whole life just was ruined and I needed an answer. She was heartless. She just said maybe he could file a request to have the denial changed. I would have to wait. I was crying and she said bye and hung up.
Now, has ANYONE ever heard of the attorney filing tardy? And if it is denied is there anyway my attorney can get it reversed??????? They satnd to lose a lot of back pay 20%. I have mountains of paperwork from at least 4 docs. So I have always felt my case should be ok. Esepcially since I am not faking it. I am really sick.
My friend who works in family law at first thought this desision may be final. But then said to wait until Monday and see what he says. Otherwise I should go to the board and sue him for damages. Also I should seek other representation. Especially since they filed tardy, gave no reason why, didn't inform me, scewed me basically. ANd the way that receptionist treated me Friday afternoon. She claims they didn't notify me b/c they just rcvd it as I called.
Has ANYONE ever had this happen???? I feel like I always get the worst hand dealt. I just don't know what to do. We are counting on some extra income or we will go under. If I work it will ruin disability and then I will get fired b/c sick all the time.
I can only hand this to God.
