Lookiing for answers, I came across your board, and thought I might find my answers here, :-) So let's see if I can make a long story short.
I was born with Spina Bifida. I have Cervical Disk, Chiari, Chronic Pain, Chronic Infections, Anemia. I've had 5 major surgeries in the last 5 years, each touted to be the medical cure, each failing.
I received SSI as a child and up until 1989 when I went to work. I married in 1994. I worked until 1995. Had my miracle child in 1996.
I stopped working because I could no longer do the job I was doing. Found out I was expecting almost immediately. Was the only successful pregnancy out of 6. After my child's birth, my health began to decline at a greater rate.
I thought about SSI from time to time, but knew my husband exceeded the monthly pay amount for me to receive it, and I was most often to ill to want to bother to fight it.
More than a year ago he says, why don't you go apply for Social Security? I replied, Honey, I won't get it, you earn too much. He said, just try. So I did. Sure enough, I was turned down for SSI just for that reason. But the caseworker says, "But, hey, you qualify for SSD, because you paid into it, and this is how much you'd get a month, so apply for this." Why wasn't I aware of this option previously? I don't know. Otherwise occupied, or just stupid I guess.
I apply. I'm denied. I hire an attorney. I'm denied again. Attorney appeals in October to the ALJ. I receive letter from judge a little more than a couple months ago simply stating where court hearing will take place, but not when.
The first week of April, I go to my mailbox, and there's a very thick envelope from the SSA. I think: It's either a very large court date, or a very large denial. Instead, I find a nine page approval letter. Judge states there's no need for a court hearing. He states I should not have been turned down in the first place. That I'm entitled to disability commencing the date of the day I left my job in '95. That the SSA has 60 days to comply.
Of course, I haven't heard anything further from the SSA. My lawyer tells me to be patient, but I'm beginning to wish I were still in the dark about approval status, know what I mean?
Will the SSA comply in the 60 days allowed them? Or are they inclined to wait until the 60th day and then say "We'll pay you such and such, on such and such date"?
