Just hope someone knows the answer

Hi, I post on alot of the boards, but never on this one. Here's my question. I live in montana and am on w/c. My doctor says I cannot go back to work and did a final imparement of my injuries that I am now waiting to find out what it will be. Under these circimstances my w/c adjuster says they would have to pay me my current pay until i'm 76. There is a big lawsuit because w/c cuts people off w/c when they get approved for ssdi or ssi. the lawsuit is mainly saying this should'nt be decided by if you get ssi or not. I would lose several hundred dollars a month by applying for ssi or ssdi. anyone else have simular suitations and does anyone else who got ssi also get w/c benifits at the same time. I don't know if anyone else here is from montana and dealing with w/c to. Please share what you know. Thanks in advance for your replys. TEXASCRITTER

Re: Just hope someone knows the answer

I donít know about Montana laws, I was injured in Indiana and received workers comp from there for 500 weeks before it ran out. Just the opposite happened to me Social Security Disability deducts workers comp off what they give you. After my workers comp ran out they have what they call a second injury fund thatís run by the state which pays your workers comp wages but not your medical benefits and even though itís not regular workers comp Social Security which is federal, still deducts it off their benefits. You can see why I picked the name I did. Most of what I get goes to co pays for medical care every month. So after workers comp state laws and Social Security federal laws get done with your case you won't get anything.

Re: Just hope someone knows the answer

Hi always broke. I could have defently used your name you chose. I'm so far behind in lot rent that if my landlord chose to I could lose our home. I'm really thinking on trying to get the best settlement possible out of w/c and just investing it. I'm so tired of messing with w/c. Everything that has been done to help my injury has just made it worse. I have choose to just get away from them before I can't even get out of bed. The big question is will the w/c have to pay me untill I'm 76 as well as ssi. Montana has set aside money to pay all the people who had their benifits cut off after getting on ssi. The case is before one of the supreme courts and the position the state has taken makes me think they believe they are going to lose and have to pay out this money. I hope that proves true. How could anyone live off of just ssi alone. Thanks for replying. TEXASCRITTER
