a friend sent me back an email. She had a claim less than a year ago and did not apply for reconsideration within 60 days. I told her that I had heard that if your claim was less than a year old, they (SSA) WOULD take it under special consideration. Am I mistaken?

Personally, I've never heard anything like that, BUT if you miss the 60 day reconsideration period, there is a chance they allow you to file late if you have a reasonable excuse. Of course, it would have to be within a reasonable time frame...probably no longer than a month or so after the 60 day period has expired.

If SS denies the excuse, then I'm afraid the only solution is to start over again.

Hi!

I've not heard of this "special consideration" either. In fact, more likely would be that they tossed her app. But there's no way to know without her calling to ask SSD directly. They are pretty picky about papers, etc., being responded to by the deadline. I'm going to guess and also say that she'd probably need to refile.
