ALJ desicion UNFAVORABLE - Disabilities Message Board

3 years of waiting...finally had ALJ hearing the 10th of July.Contacted the lawyer after several weeks..she didn't know.Called the ssa toll free # a few times.Today I contacted my local SSA office.Was told the desicion is unfavorable and that my letter should arrive in a few days!
I am shocked,mad,sad,depressed,and overwhelmed that this what I am now faced with after years of preserverance.
Can't wait to see what the letter will state.Probably that Despite...Fibromyalgia,herniated disks,cervical stenoisis,lumber compression,nerve damage,knee arthritis,possible M.S, brain lesion etc....That I can be a GATE keeper!Or a ticket attendant.GEE...why didn't I think of that before I applied???
Medical bills...behind on the mortgage etc...Two kids loved that I wish I could do more for...What now???
Appeal?How long will that take?What will be the chances?
The GRAND USA...such a fair place to live!MB

Oh maebell I am so sorry to hear this ... I really feel for you.... I have my hearing Aug 28th. I am very very nervouse. I know deep in my heart you and I should both be should be approved but I already know in my heart I will be not be approved either. I am like you. I have mort payments , med bills, kids and a hubby that just can't work two full time jobs anymore. I have worked my whole life ( I am 45 ) I worked the same job for 20 years and I loved it. But there is NO WAY I could ever work again. It's been 1 and a half years since I worked. I can barely take care of myself now and my pain is constant. I hate knowing my life and my families lives rest in the hands one judge. I wish the judge would live with me just for one day to actually see what my life is like. I look normal but no other woman would be able to stand my kind of pain. Once again my thoughts are with you ..........Please take it further.......dont' stop now. I know I won't stop appealing because I know I can never work again and eventually they will approve me and YOU and we will get our backpay and it should be HUGE , LOL...... take -care

Hi Maebell! I too am sorry to hear that you weren't approved. I haven't checked into this part of Healthboards in awhile and so I'm not familiar with any of your previous postings. Was this an appeal after an initial denial or is this just the first rejection that you've received? I was initially denied my claim (as I think most folks are these days - no matter how disabled we think we are!) and then I hired an attorney who prepared my appeal. It took months and months to be advised of a hearing date. It was at the hearing that I think the "powers that be" really took a good look at my case. My disabilities probably weren't even as severe as yours at the time, but I had severe and chronic pain from several back operations that had failed, I had nerve damage and broken bones from a 2 story fall from a window and my body was like a human Home Depot because of all the metal and screws! In addition I had rheumatoid arthritis and lung disease. But still.....you sound like you are in a bad way. I would recommend that you appeal this decision and fight it as long as you can. Don't let yourself get so discouraged that you throw in the towel - that's what SSI is waiting for most of us to do! Getting another bite at the apple with an appeal will most likely be the thing that gets you approved. Please take care - Memere

Maebell, I am sorry to hear about you unfavorable desicion. I had my hearing last month on the 24th, I am praying it is fully favorable.
It seems you have quite a few things wrong. Have you been under constant Dr.'s Care, and are you on a lot of pain medication and anti depressents? What state are you in?
I am just trying to figure out how they could of found your application unfavorable. Don't stop here, you have come to far. You need to keep fighting.
