tell me what workmenscomp is

tell me what workmenscomp is and if I was hurt on the job and had surgery also returned back to work even though I wasnt ready but there doctor release me back and upon returning my job fired me my back is really bad and im not getting any pay or anything what can be done?

hi Reajon, workman's comp. is insurance your employer pay for their employees, premiums based on your wages, if you're injured on the job? it's supposed to pay for your treatments, medications, and everything surrounding your injury + pay you bi-weekly 66 2/3 of your regular pay. the first thing, when/if injured? you needed to fine an incident report of injury with your supervisor! did you? every state has different workman's comp. laws, you can find your states' laws on line through your search engine.

you need to find a good W/C lawyer NOW! first consultations are usually free. if they take your case? they get paid on a percentage basis like 20% if they win? nothing if they don't, make sure you get a lawyer who specializes in W/C! not one who takes all other cases as well they'll know or research your state laws and help you through everything, just remember, they may be working 25-50 other W/C cases at the same time!? it may seem like they're not doing anything on your case? but they are/ it can be a slow long process but hang in there. your employer may deny your claim? as well as their insurance carrier may deny treatments or anything and everything? let your lawyer handle them. you have enough on your plate as it is the insurance company, may assign a nurse or a case manager to your case? remember these people are NOT YOUR FRIENDS! their job is to save the carrier money.

I've been on W/C for hoing on 16 years and never had any trouble my nurse case manager never tried to interfere in my case in any way. be very careful with anything you say or do in front of them? they'll turn it against you if possible? also be very aware of ALL your surroundings at all times! they hire private eyes to spy on you even video tape you. trying to find the fakes or malingerers in order to close your case completely!

Thank You! Im not doing any thing to make my back any worse then it already is but ,its hard not having the income that I use to have. I thought it was against the law to fier a person that is still under a Doctors care. Am I wrong ? Im deeply hurt by what happen with me and the job and how they handled the whole thing. I liked my job but they treated me like I was a bad person ,and Im not and my back has a spinal cored injury that affects everything that I do on a daily bases. Im not getting any income at this time and I really wish I could have my job back ,but I cant stand-up for long at all and they said they dont do light duty work. Also I was not represented correctly by the union on the job,is there anything I can do about that?
