Wink Re: SSDI Does each child get half of the amount as parent?

What I believe happens and I am not sure of this because I have had one alj hearing and I appealed it to the appeals board myseld and one and overturn and have another hearing in front of the same judge the 30th of this month but I have an attorney this time. I have been told that since appeals granted me an overturn of the alj decision and it was based upon what I wrote it must have been some big error the judge made. However, they give one amount for the kids it -if you have one child they would get that amount until age 18 if you have more than one child it is split between how ever many children you have and they each get a portion of the money. If then one of the children turns 18 then it would be divided up two ways instead of 3 if there were 3 children before the one child turned 18. the checks come in the child's name and your name so that you can open a bank account up for them with the money.

Half of what you're getting will be split among the children, so if you have one child, you will get 1100, the child will get 550. If you have two children, you will get 1100, each child will get 275. In your case, just divide the "child amount" of 550 between how many children you have.

Yes, the child will get back pay - maybe. Your son's age will have an effect on the situation. My son will get it, but he drew SSI before getting approved for DAC, so they will recalculate. I think this is the calculation, but don't hold me to it: Total SSDI back pay due minus actual SSI paid out equals how much he will get. His SSDI monthly benefit started in January, but he still doesn't have his back pay.

This case has confused social security, and they kept halting and/or reducing his monthly payments, said they had overpaid him. Then they tried to calculate it on his dad's record (much less money). Then the clerk tried to say he wasn't due any back pay, then the supervisor said he was, based on how I filed my claim. The lawyer's office talked to them (over and over and over), and I think it's all worked out now. He received his fully favorable letter in November, 2007. He's still waiting on back pay, though.
