New Case..What Happens at Appeals Council??

I am considering filing a new case. I have my case now at the appeals council.

My question is..Does anyone know what happens to my case at the council if I do this?

When my case finally does come up at the council, is it just thrown out because I filed a new case or would they offer me some sort of settlement on my back pay?
This is assuming I would win the new case.

Anybody know, or gone through anything like that?

My case has been at the appeals since jan 2008. I filed a new claim in feb 08 and was awarded SSDI. I have since recd checks. Nothing happens to the new file and when the appeals gets around to looking at your case, they either grant or not.

Your case at the Appeals Council will continue to a decision on your original claim. This is why it is usually a good idea to file a new claim while appealing an adverse decision by an ALJ.

So when your case comes up at the appeals council and you have already won your other case...What is it that they approve, your back pay???

No, if you get ssdi on ur new case that does not mean u will get it on the Appeals case. THey are 2 different issues.
