Is it bad if they haven't requested I see their disability doctors?

I filed for Disability about six months ago. I received my first denial in the mail. I then hired a disability attorney and we sent in our appeal. Disability called and asked me which doctors I have recently seen so they can pull those records. That was about 5 weeks ago and I haven't heard anything since.

My attorney told me they would probably have me seen by a doctor that works for Disability. Why haven't they requested this? Is this a bad sign? Are they just going to deny me again?

I turned 36 this week. I have had 2 back surgeries. I have permanent nerve damage that results in pain every second of my day. I cannot sit or stand for long periods of time. I have had six nuerosurgeons confirm that the damage is permanent and there is nothing more surgical that can be done for me. I live on pain pills to make it through the day. I also am seeing a psycologist to help me with the mental part of all this.

Thanks in advance for any help with this.

Hi,

It sounds like you have been seeing doctors on a regular basis, so they may just use those records.

I also have back problems, and am almost two years into the SSDI process. Since I have been getting regular MRIs and seeing my doctors regularly, they did not ask me to see one of their doctors before my hearing (which was about 6 weeks ago).

You may still hear from them, asking you to see one of their doctors. Sadly, it is a very slow process, and it could be months before you hear anything.

Did you sign Dr's release of medical record forms? When you apply is says to do so. I filled an online applications and signed the release forms at the same time. It takes a couple months for the reconsideration, which you will probably get denied since you are young. Just having a back problem (I know it causes a lot of pain) but they will try to see if you can do anything else. What did you used to do? If you get denied it will then take about 2 years before you get a hearing.

Hello I live in Ohio and I filed for SSDI in june 22,2009 I been diagnose with fibromyalgia in 2003 and worked on intermmitent FMLA since 2004 -2005 -2006 did not renew my FMLA in 2007 tranfer to another facility pain was very bad in my pelvic renew my FMLA inttermitent in 2008 found out in May 2009 I had dry thoracic disc in T10 through T12 and Lumbar herniation in L4- L5 was told over the phone my annulus were tore and had a slight scoliosis toward the left, my Dr. sign a return to work permit with restrictions ,My job said they have no light duty. Now today my DR say he see no reason to return to work . my job is patient care thats lifting pulling rolling sick people I need pain medication to give my self a shower. I told him I am not doing patient care anymore and I will go to school to find another trade. but my pelvic keep hurting when I sit I had one epi injection on the left side but now my right groin hurt like nerve pain it hurt from my groin into my low abdomen down my leg into my knee , so now he order a EMG electromyography to see if my muscle and nerves transmitting abnormal, I am shcedule the end of this month for it. I don't trust DR. I sign release papers for SSDI to get my medical papers I think that the dr. is going to say I can go back to work but I saved all my papers and medication bottles. and documents when the dr. say I can not work. Do you think this will hurt my case? I wont the State examiner to examine me if they decide to examine me I will make sure to go so they can see them self if I am capable to go back to work. And I am on unpaid medical leave so they is only paying my medical bills I am not getting any income I had no income since June, So I see no point in rushing to injure myself going back to work its been 30 days no income and I have no PTO if i go back to work doing what i been doing my back and pelvic problems will return. I did not hurt myself on the job I got hurt at home before I worked 8 years for my employer.

It depends a lot on what they see in the medical records they request and if it answers their question as to your level of impairment. It can take your doctor's office a while to process the request for SS - so that's part of the delay. Then SS has to have each set of records reviewed - they may wait for all to be received. So sit back and wait a bit....keep in mind that SS moves at the speed of molasses (on a good day).
