Question The judge wants to see me?

I was told b my attorney that the Judge wants to see me, even though he said I have all the paper work that shows I am indeed a mess.

I got a letter from my neruo-surgeon stating that i will have to have thoracic spine surgery in the next few month, along with my list of issues

So I asked my attorney if the letter would show the judge that yes indeed this guy is a mess and she would just approve it. He said she want to "see" me?


Is this good or bad?

Is it hard to believe that a 35 year old man can have

A syrnix in my spine

2 herniated disk pressing on my spinal cord t-6 t-7

depression

anxiety

severe arthritis in my knee

epilepsy

severe mood swings

chronic back pain

permanent nerve damage in my shoulder,arm and neck

Nerves detaches from my spine

I cant stand for more then about 10 min

I cant go a whole day with out having to lay down

I take cymbaltia,zanax,darvocett,keppra,depakot a,zoloft every day

I have the letters filled out from my dr's saying i can stand lift etc

What would the reason she would still want to see me??

Does she just want to say hi in person, or make me prove that i do exist?

I have requested a on the record decision twice and no joy.

We are living on $500 a month that we get from my father in law just for the basic's and we get food stamps(thanks jesus)

My wife stays home to take care of the 4 kids because i have a hard enogh time getting up and down stairs on my own.

My hearing is Sept 8th and My atty said that we can request that she make her decision asap due to financial strain.

Do you think i have a good chance of approval and if so do you think i have a good chance of getting a decision (back pay ) asap

God please help us, we are on our last leg of hope.

It has been a long 3 years since my accident (17 foot fall of a roof) and with all this going on it is hard to try to heal and get ready for more surgeries

i can't believe you got turned down on a on the record decision. i have read several times that if they do an on the record you probably will get approved. if she wants to see you then i would imagine you've got it now. so congrats..lets us know what she says. my attorney wanted me to see a dr at his office i did 2 weeks ago and haven't heard anything since. waiting patiently for 10 months altogether

My own attorney recommended that I not ask for an on the record decision as he felt it was in my best interest for the judge to actually see me in person. I know I am glad I did as it was apparent that the judge recognized my distress just by my appearance and actions during the hearing. I stammered and sought out the correct words and had to be reminded of some of the things I had wanted to point out. The judge allowed me to more or less detail how my health affected my daily living. Not just the pain and discomfort but the not being able to sit for any length of time, dropping things, unable to type with any speed now, all things that greatly affected my ability to perform on a job. I know that I testified that I too lie down frequently throughout the day on most days.

I would view this as a positive sign. At least it is not a NO, so there is still hope that when you address the court, YOU will be heard and not just be another name on a piece of paper. I do hope the hearing is successful.

BTW, my file was about 18 inches thick so I doubt the judge took the time to read every little test and note. I am glad he got to see me.

I think seeing you gives the judge a total picture.

My hearing was two months ago, and I think it helped in my case. I had to walk a long way to get from the parking lot to the hearing office. If I had known it would be such a long walk, I would have brought my walker, instead of just my cane. So, I was in worse than usual pain by the time I got to the hearing, and I am sure it showed on my face.

Even if your paperwork shows you are a mess, seeing you and talking with you can confirm it in the judge's mind.

I agree 100% with Gayle. We have to all remember that these Judges are tasked with the very difficult decision to decide our fate (in financial terms). Additionally, there is a certain % of fraud cases out there and since the Judges are potentially handing out the "people's" money, a certain amount of diligence must take place. Granting disability is often for life, thus, they don't want to leave a stone unturned.

I would just accept it as something that has to be done and given all your conditions and etc., I'm guessing it won't take the judge long to figure it all out. Trust your atty....He/she knows what to do.
