1st Denial - file appeal? or get an attorney and let them do it?

Hi guys... just as the title says... 1st Denial - file appeal, by myself...

or get an attorney and let them do it?

I was denied and I appealed it. The work comp attorney I had wouldn't take the case until I was turned down twice, apparently common. I asked for reconsideration and was turned down. I couldn't get hold of my attorney who retired so too much time elasped so I started over myself. I was approved in a month. I was shocked.

I say get the attorney. It spares you some aggravation and increases the chances that you will be approved. The charge fee is worth it IMO.

This is amazing. You never got to the ALJ level correct on the initial application? You simply reapplied after the second denial from the 1st application and won. Incredible! Congrats on the win!

Does anyone know what the average time is - after filing for reconsideration? If anyone can shed some light on this, it would help me, and others.

Average wait time = 3-6 months. It took approx. 7 months in my case before I received my 2nd denial.

I took 4 months on me, In texas it seems to take 4 months there are places you can look to see what your state stats are but like everfything else with ssa there is no rhyme are reason and just because tit takes longer doesn't mean deniel. Can you get your DR. to fill out an RFC form and can you offer more medical edivence because I was told it helps to offer more things while you do reconsideration I would get a lawyer because they stay in contact with ther person at ssa and they can make sure things get there. Yes they do lose things and make copies of everything and make sure they get it. I would type in reconsideration stage in your state and see what the wait time is and approval ratings it used to be a stage that was most certain another deniel but things has change I have seen more people get approvaled at that stage expecialy if new medical finds maybe they did'nt get all your medical records on time I would get a lawyer you will get approved its just a matterof when. I'll be praying for you

On my first claim, it took one month before getting a denial letter at the reconsideration stage. On my second claim, it took four months before getting my approval letter at the reconsideration stage.

I also say to get an attorney. At this stage, they can only help.

I would get an attny asap; wish I had when I first filed in Jan 2010 then was denied in July 2010. Refiled Jan 2011 denied February 2011, appealed April 2011 so I'm waiting to hear something now - they've sent forms for my new dr's to fill out recently.
