Still waiting on ALJ decision

I originally applied in July 2009. Had my hearing in February. ALJ sent me to a psychological consultative exam in May, and still no decision. I'm trying to stay positive and see my doctor regularly in the meantime, but as all of you know it's difficult. I used to think, if I can just make it to my ALJ hearing, it will be over...but nope. Another long wait. I wonder how long this can possibly drag out?

Reading this board still helps. It's always wonderful to read about someone being approved here and there!

The wait time is the worst. Nearly everyday I want to call the 1-800 number and ask them if their is a decision yet. It is So hard to have to wait for the maili all the time just to be let down that their is nothing yet. So many of can relate to this feeling. Hang in there pme. I hope a positive decision is coming for you very, very soon.

I just put my lawyer's examiner on notice. If they don't let me talk to her supervisor or the attorney himself I will drive to the local SS office and sign whatever I have to. I'm so angry I could scream!

Thank you I sure hope it's over soon. Although as much as I want a decision, I don't know what I will do if it's unfavorable.

Wishi -- Are you saying your attorney won't speak to you or return your calls? I have had difficulty with the firm I am working with too. Besides our initial meeting, and the ALJ hearing, I've never been able to speak to my attorney or even the paralegal. The person answering the phone always just tries to pacify me with a little information.

I met my attorney once at the hearing. He advised me to change my onset date to what I had medical records for. I didn't feel right about it but agreed. It was the first and largest reason the judge found me not credible. Said so in his decision in fact. My file has been sitting at ODAR now for 5 months. I call to ask a question and yeah if the paralegal gets back to me she is always condescending and NEVER helpful. I fired her today! They have until the end of the week to make it right or Monday I will fire the lawyer on Monday!

You can change lawyers by just sending a letter to the lawyer, stating that he is fired. Send a copy to Social Security. Then, hire another lawyer.

Be aware that the lawyer you fire may have a claim for some of your back benefits, because of any work he/she may have done on your behalf Social Security WILL honor their request for payment. So it may be hard to find another attorney willing to take on your case as they may not want to fight for payment. So find a new lawyer first before hiring this one.

Curious Wishi? What onset date did your lawyer have you file for and what was the original onset date? You said the judge found you not credible because of this? Could you please elaborate? I take from your post that you think the lawyer had you change this date to maximize his own payday which was probably not in your best interest.

The original onset date was May 2003, the last time I worked. My lawyer had me change it to September 2007 I think because that is all the medical records they said they could get. I filed in 2/07 because I was running out of credits to qualify. It was very hard for me to accept that I was disabled. WHO wants this? I've had many of these issues for most of my life but I was taught you had to take care of yourself in this world so yeah I pulled up my bootstraps. I worked from my 16th birthday until I couldn't anymore.

I've decided I'm going to the attorneys office today. That condescending lady that they assigned to my case never had a supervisor or the attorney call me. Big mistake, HUGE! I would never resort to violence but there are other methods. If I don't teach my son anything it will be that you have to stand up for yourself. You know the system treats you like this your own attorneys office shouldn't. So another sleepless night. I'll use the time to choose my words.

So you filed in 2/2007. You have been trying to obtain benefits for over 4 years? Were you denied @ the ALJ level? What is the primary cause of your disability?
