hi all !! i wanted to share my exciting news! had my alj hearing today and i was approved-fully favorable !! this is in re of my second claim... so still have the first claim sitting at dist court awaiting the judges decision..
i do have one question.. since this approved claim was filed in feb 2010, the judge can only pay me one year back to feb 2009. however he said he was setting the date of onset to early sept 2008 (which was when the alj of first hearing wrote his letter of denial).
my question is, since i have the one claim pending at district court awaiting decision, can the approved claim be paid backpay to sept 2008 instead of feb 2009? from sept 08 to feb 09 is about 6 months, wouldnt that cover the "waiting period"? or does the waiting period start from the first month that the alj can actually start paying you from (feb 09)? thanks!

Yeah, you can only get backpay I think one year prior to the initial application date. The ALJ awarded you enough onset date to cover the full 5 month waiting period.
1. EOD = Sept.08
2. 5 months = Oct/Nov/Dec 2008 and Jan/Feb of 2009
3. Looks to me like the backpay should start from March 2009.

thanks for all the congrats ! it has sure been a battle !! which is only half won.. yeah, still got the first one to deal with, but at least i will have an income now and i have taken so many deep sighs today it is unreal (in between my bouncing off the walls -lol)..
