unappealed review
 
hey all have not been on here for awhile. Thought I would update everyone on my status.
So I was approved from the ALJ on July 22. Yesterday I get a letter from the appeals court stating they have pulled my file for their own decision review! Stating there was not enough medical evidence for an approval??? When I went to see my shrink yesterday I told her this and she was actually mad since she had sent so much to the SSA stating I cannot work any type of job.

I have 25 days to send them any new info, I have an appointment with my lawyer next Tues so hopefully she will know more of what to do.

I really don't know why there was not enough medical evidence they have my records all the way back to when I was 18 and even my military records stating a medical issue was why I was discharged in the first place.

Has this ever happened to anyone else? The letter states they can either chose to have an argument called to them or they can just send my case back another ALJ, they have like 200 days to make this decision and it says after 110 days Ian put in a request to be paid if they have not made a decision. I am so frustrated.

:(I am so sorry for you. Thats horriable. Your saying the alj approved you did you start receiving benifits and they over turned the alj judge I didn't think they could do that. seems like the burden of proof is on them now. and could it happen to others that got a alj approval are for that matter others that had got approved. Again I'm so sorry this happened to you. and you have to wait a huge amount of time again.:(

no I never started to get any benefits, it can happen to anyone who has been approved I was told since in the ALJ fully favorable letter it states in there that the appeals committee can take your papers at any time within 60 days after the ALJ approval. They now have 200 days to either keep the decision or deny it and send it back to another ALJ.

I see so anyone that gets a alj approval basicaly has to wait another 60 days to see if their case will get pulled for a review committee. they may not but then they might? is that correct? that is very helpful information to know. are to keep in mind for all those that won an approval at the alj level but then it probly states it in all the letters right. I will be praying for you in the hopes they will let the alj decisoin stand.:angel:

It's SS's version of "Quality Review". During the review they determine if they agree with the decision. That's why SS staff may tell someone verbally "approved" but that's just what the screen shows on the computer, it may not have gone thru review and thus denied in review.

It is like a QR but different, I already had a QR right after the I had my hearing my paperwork stayed with them for 4 weeks. this actually only happens to about 2000 people each quarter and about 8000 each year they only pull for own motion review if you have been approved by an ALJ not if you were denied like QR where they pull either.

It say's in my letter they will most likely send me back to another ALJ for a new decision, but I am like if this new judge approves me will I go through this process over again? You can't pull apart anything the SSA does or you would just sit and rack your brain for hours on end. I am just letting my lawyer deal with it now I am to over-emotionally extended now to deal with it any longer. One day I hopefully will get my hard earned money I paid into the system but for now I will just wait and let god make the decision. I could barely make it to the first hearing so hopefully any new evidence I show from my recent dr. visit will be enough, but who knows.

oh wow I'm so sorry you're having to go through this. I can't imagine going through being approved then this happening and haven't read anyone else go through this before.

hang in there I hope you get through this phase quickly and this is done and overwith soon

I hope the new evidence will make a good impact for you and your case . You have been through so much already. It is good to let your Lawyer deal with it . Best wishes to you !

Thanks all I see the lawyer tuesday so hopefully she will have something good to tell me? like I said I am just putting it all in her hands now.
