ALJ approval/denial rates

I just found the latest ALJ disposition data. For anyone who wants to check it out or look up their judge, the URL is:

http://www.ssa.gov/appeals/DataSets/03_ALJ_Disposition_Data.pdf

The records are for Sept 2010 through August 2011.

Ok, here is my ALJ.

Total ALJ
Dispositions

All Offices = 278

Decisions = 221

Awards = 176

Denials = 45

Fully
Favorable = 172

Partially
Favorable = 4

* I was lucky. I got a really good ALJ.

Re: ALJ approval/denial rates

My ALJ approved 176 out of the 221 decisions.

176/221 X 100 = 79.6% approval rating.

Pray you get an ALJ with a good approval rating. It improves your chances at level 3 IMO despite any compelling medical evidence.

Re: ALJ approval/denial rates

The judge who denied me had a very low approval rate when I had my hearing in 2009.

It looks like he is still not approving very many people. Last year, he only approved 94 out of 419 people. That is a 22% approval rate.

Wow Gayle, that is crazy. You pray you do not get someone like this. I think some of these ALJ's have a subconscious prejudice against ppl who file disability claims. Some think we are all just lazy and wish not to work anymore. You almost have to be near death it seems to get approved by some of these judges. This is a sad fact but a true fact I think with a few of the ALJ's. It is good when they catch and stop the scammers but they deny many more legit claims than they should IMO which just causes more people more suffering and more disability. SSA is not giving us anything for free when they approve us for disability. We all paid for this disability insurance with FICA taxes just in case we did become disabled and unable to work any longer. I simply see myself as now unable to work due to my medical condition and had to file two legitimate disability claims (LTD and SSDI). Some ppl try to make you feel ashamed because you are on disability but we all have absolutely nothing to be ashamed about.

Re: ALJ approval/denial rates

Well, I had my hearing in February, but am having a supplemental hearing in December. My judge's approval rate is a bit lower than his denials. Has me a little more worried now!

Thank you soooo much for this site! I just got the name of my ALJ judge, so I can see that she has approved 349, and denied 76. Seems like good odds. I have been soooooo worried lately. I had received a letter in the mail from SS and it appeared to me that they were going to review for an OTR decision, but my Atty office has been HORRIBLE, and I FINALLY got a call back, after calling for weeks, and they told me that they didn't receive anything, but no, it isn't an OTR letter, it is just letting me know we are getting closer to a hearing. SO I don't know what to believe. I at least feel a little bit better knowing her approval rating is high. Thank God for that!! And thank you so much!!

Re: ALJ approval/denial rates

Congrats. I would say you have a very good chance at approval. Your ALJ's approval rating is higher than mine. Please come back and update when when hear something.

Good medical records + good doctor + good ALJ = the best chance for approval @ level 3.

Wow Gayle, that is low! My judge isn't quite that bad, but could be a lot better.

Re: ALJ approval/denial rates

Thanks!! I do feel a bit better now after seeing that! I will definitely come back and keep everyone posted. I do meet a listing, so I'm hoping that will help also. This board has been a God-send. Although I haven't posted much, I've been lurking around reading and have gotten so much info, so as I get info, I will be more than happy to repay the favor by posting my info. Just waiting to hear if OTR decision, OR a hearing date. Hearing was requested 12/2010.

Explain Rarebitrabbit. This same ALJ denied you initially but later you received a fully favorable decision from him? Please elaborate.

I went to the appeals council they vacated his unfavorable decision based on new evidence and remanded the case back to the ALJ for a new decision. a new hearing was held and he issued a fully favorable decision this time.
