Rep payee problem

What happens if the person for whom you are a representative payee gets hold of the debit card and clears out the bank account, transferring all money to an account the rep payee has no access to? The debit card had the name of the person receiving SSDI on it and he took it.
Are there legal ramifications for the rep payee? for the person receiving SSDI?
How is this remedied?

I believe you would have to contact SS and see what they say. If it is the payee i do not know if there is anything illegal going on unless it is a court ordered payee. That is just an opinion though. I would definitely call SS tomorrow morning and see what can be done if anything

Are you saying the person that is suppose to help the person who is disabled took that person money Or are you saying the person who the money is for but is to disabled to make desicions for themselves took their on money I think there probly is legal issues on both cases but I would ask the ssa are a lawyer. Wish I could help you but please keep us informed it helps others.

If you are talking about the disabled person getting a hold of his own money and not allowing his Represenative Payee acsess to then the payee needs to contact social security and report it. The reason why a person has a Rep Payee is because he is not able to manage his own money and needs someone to do that for him.

Thanks for the responses. The person the court deemed unable to take care of his financial affairs cleaned out his account without the permission/approval/knowledge of the representative payee. She will contact an attorney tomorrow.

I see the disabled person took thier own money without the knowledge of the person looking over the money for that person . Will you please come back and post to let us know what will happen, For sure the disabled person is not in his right mind so how can they press charges on someone not in there right mind. I sure that has happened before seems like the bank wasn't watching for the correct person to let that person do that like maybe it was not set up right at the bank.

I agree with what others have said. The only thing you can do is contact SS and let them tell you what needs to be done. If his debit card was used to withdraw the money, how did this person obtain the PIN? I mean the rep. payeee knew the PIN, right? I don't see where anything (really bad) illegal was done since this person took his own money.

I agree blueskies14, seems like they need to change pin numbers and alert the bank not to let so in so get the money. Also do the rep payee have to have receipts showing what they spent the money on? Did you see that case I think it was in Philly that people were held in chain locked in an apartment and the group of people were collecting thier ss money sad very sad.

Yeah, I saw that jgrangran. There are some really bad people on earth who we share the planet with. One must be absolutely certain any individual who we give power of attorney over our lives is trustworthy.

The rep payee in this case is trying to do the right thing: pay rent, utilities, etc. The bank set up the account incorrectly and sent the pin to the person on SSDI rather than to the rep payee. It was a bank error and the rep is going to contact an attorney and the bank. Thanks for all your responses.

Contacting a attorney is a good thing. The disabled person needs someone looking after his social secutiy payments because he was found not able to do it on his own. I don't know the repercussions if any because like Blue said it was his money. He would have had to gotten a hole of the debit card and the pin number . Their are cameras so the represenative payee has proof . PLease come back here and let us know what the outcome is.
