OTR and Bench Decisions

How many people here besides me and Vann got OTR fully favorable decisions? How many people here got a bench decision @ level 3? Both OTR and Bench decisions must be fully favorable decisions. I am not really sure Vann would qualify as OTR because he was approved at level 2 just like Mscat and a few others.

Ok, sorry Vann. I just could not remember. I keep thinking you were approved at level 2 for some reason. I was just curious how many other ppl received OTR or Bench decisions @ level 3. Hope you enjoyed your weekend Vann.

Approved at level 2.....as there is no level 2 appeal in NY. So I was approved without having to go to a hearing.

Re: OTR and Bench Decisions

I've been told once my ALJ hearing is scheduled the SS attorney will ask for an OTR in lieu of a hearing. If the OTR is denied then I go to the hearing.

That is great Spine. I think you will get it plus OTR's are always fully favorable. I have my fingers crossed for you.

Re: OTR and Bench Decisions

Out of work due to disability eff 4/2009. Employer STD 4/2009-10/2009. LTD 10/2009 to present. 07/2010 LTD mandated SS application. Initial app via atty 8/2010. CE exam 10/2010. Denial 12/2010. Atty filed reconsideration 01/2011. Denied 06/2011. Atty filed for ALJ 07/2011 and we were told 8-16 mo until ALJ. Attorney has said they've been told it'll be relatively soon. That could mean anything from 3-12 mo from now.

Re: OTR and Bench Decisions

I received a bench decision on Oct 13th. The judge held my lawyer back after I had left the hearing room and told him. I found out from my lawyer. I am still waiting on a letter. My congressman called 2 weeks ago to follow up on my case and was told it would be 2 weeks - that would be today. Yesterday my lawyer's office called and they told them "it should be no more than 2 weeks". I assume this is their response to everything. The waiting is killing me. Now I question whether I won, but my attorney assures me that I did, in fact, win. They did call and ask for a copy of the fee agreement so I assume this is a good sign!
