Hearing soon. Need advice and encouragement

Hi all.. I am not new to Healthboards but new to this forum. I am 38 yr old male who was nearly killed in MVA in 2008. I had both cheek bones reconstructed, skull fracture, subderral hematoma, seizures from the scarring. Since the wreck I have been to see a neurologist regarding Epileptic episodes that are only now somewhat under control. I have had all the EEG studies and yet to have 1 caught on camera. I take so much medicine for seizures I am a total zombie, thats with out the meds for HBP, and Back issues. My neurolgist has wanted me to see a neuro psych for memory issues for over 1 yr now. For financial reasons I couldn't. My ins has now ok'd the visits. It is well documented in his notes he believes I am epileptic from the converstaions with my family and with EMS driver who seen them in ambulance, Also my memory is well documented. I am just concerned that the Neuro Psych will think I am malingering. IDK what tests they do. I am not retarded but do forget simple everday things. Like did I take my meds? Leaving the stove on, forgetting the day etc. He asks me what color a bannana is ofc I will know. Thats my concern there. I have also had a TLIF fusion l5-s1 in Jan 2011 and was referred back to PM for testing. Although the fusion is doing ok the stress has caused more dysfunction in my SI Joint to a point they did nerve ablations and its came back. The only other option is a fusion there. I must take Oxycodone 15mg q 4-6 hrs and Zannaflex 3x day just to maintain. I am unable to sit, stand walk for more than 20 mins each due to the SI Joint pain and its made worse from the fused area putting stress. I can recline and lay down but only for small increments before needing to move around. My PCP treats me for HBP and is aware from records what I have endured. I have yet to ask him or my neurologist or neurosurgeon or PM for "letters" on my behalf.
Is this something I should do? How do u ask a doc for something like that? I think they are all in agreement I have a disabilty but want my basis covered. Any suggestions, similar stories etc would be great. I assume I will have enough data to prove my case I just want their support in writing. Please chime in..

X

Re: Hearing soon. Need advice and encouragement

First Welcome to this board. Second You never really know with ssa some get it quick some have to wait years. I sure hope you get your quickBut just know this is a place you can come for support and encouragement lots of people on here have lots of great advice. My advice is do you have an lawyer? If not you really need one. and always make copies of everything you send to ssa and get all medical records everytime you go to the DR. remmber to always check to see if they (ssa) received everything. If you have a lawyer they will probly do that part for you. Make sure you pick a good lawyer the best only handle ssi/ssdi cases. Also stay on top of things with your lawyer. If you have read this board you know it can sometimes take years so just remmber if you can't work then appeal each deniel. I really think they also look at how the meds make you feel. I know others will respond keep checking back. I hope you Have a Great Day. Please keep us updated.

Re: Hearing soon. Need advice and encouragement

I forgot Yes you need to find out if your DR's are for your Filing disability It sounds like your DR's will be. If you can ******** this form called RFC and the next time you go to the DR"s have them fill it out it is most helpful. I know its kind of scary to ask or tell the DR. about filing in fear they moight not be supportive. I was suprised with all of my DR. because they thought I was already on disability. I bet your DR's will be supportive its better to get that part behind you. While you need there support I have read where you can win without there support if you have enough rmedical record to back it up. Hang in there.

Re: Hearing soon. Need advice and encouragement

Thanks so much.. Yes I do have an attorney who has won more than 3500 cases since coming to our area. I did research the judge is Wendell Sims and he only approves 51% they say on SSA web site. That concerns me. Idk if my attorney has a good relationship or not. I hope when I see him he can tell me he does. Hearing is 1-18 and I have so many appts b4 then I hope it will help. I am just really worried..

Re: Hearing soon. Need advice and encouragement

Oh I see you have already done a lot and are going to see the ALJ Judge. Well I wish all the luck in the world for you I will be praying for you. I can understand your nervesness Just let the lawyer take care of things sounds like he a real good lawyer your chances seem good that you will win but you never really know I would just ask the lawyer if there is anything else you can do on your part to help the case any. I think your lawyer will know . Hang in there I hope you will get OTR approval on the spot please come back and let us know. You sound like your a pretty strong mined guy you went thru those deniels and didn't need support WOW. Hang in there and let us all know how you feel the hearing went.

Re: Hearing soon. Need advice and encouragement

It sounds to me like your disability is more physical than mental/psychological. Why so much emphasis on the neuro psychologist? From what you wrote, you definitely qualify for disability IMO. Have you been able to work at all after the MVA? Good luck on the upcoming ALJ. I think you will prevail.

* A letter from a supportive doc is always helpful. My disability advocate got my doc to write a disability narrative on my behalf. They even paid for it.

Re: Hearing soon. Need advice and encouragement

IDK the reason for the Neuro Pysch being pushed. I suppose it's to test my cognitive memory which is really bad. And no I have been advised not to work since the MVA. Seizures ofc so they pulled my DL, the amount of meds I take and then the surgery and hardware in my back. I just hope the judge will be understanding and fair..

Going to a Neuro Psych will help make your claim stronger . The Dr. will test your cognitive functioning in all areas of functioning. This is a specialist and will provide you a detailed report after the tests are over , it takes a few weeks to get the full report. it will not only be for memory . The test results will show your strengthen and weakness in certain areas of functioning.
my son went to a Neuro Psych. a few years ago due to autism/and cognitve delays , After he turned 18 I used the Neuro Psych. report when filing for disabilty on his behalf. Social Security sent him to a CE , and the CE had a copy of the report, a few weeks later my son was approved at the initial stage.

Re: Hearing soon. Need advice and encouragement

I'm sorry you've had to go through so much. Try not to worry too much about the neuro psych, you have legitimate issues going on and if that Doc doesn't want to listen, you may have to find another. You're going to do just fine at your hearing, you mentioned the Judge only approving 51% of cases, before my hearing I was told that the Judges where I had to go don't look favorable on guys my age, that was a big concern for me but I went in there with my attorney answered all his questions and it went well. The other folks are right, you have all the support and encouragement from us. My best to you.
