No OTR i have hearing scheduled
 
I just talked to my lawyer and i called the ODAR that is handling my case. I am not getting and On the Record Decision. They are making me go to my hearing which is scheduled December 13th. This means i have to move out of town. Does anyone know since i am moving out of town/county will it change anything for my case. I have no where else to go and i am changing everything to go to my new place this week as i am not moving for another week at least. So my worse case scenario is happening right now. thank you all

I wish I knew the answers. You may want to call ODAR and speak with the Judge's clerk. She may know what needs to be done. Good luck.

I did talk to the clerk. She told me i needed to talk to my lawyer and basically said to stop calling them. That made me chuckle. I wanted to tell her i would stop calling if you just approved me already but i knew that wouldnt help my case any

Sorry to hear that but things will get better. At least thats what i keep saying. I know it will it just takes time and i am just about out of that. At least mentally i am out of time i am going crazy

I am sorry your claim did not get a on the record decision .one good thing though is that you are scheduled for a hearing. Hopefully that will work in your advantage. Be sure to notify social security of your change of address , and phone number if that applies. If you are moving out of the county the local field office will change so keep that in mind too , make sure the new field office has all your current information. When I was in the process applying for my sons benefits i recieved a letter in the mail that had the very address of our old field office, we had not lived in that county in 8 years.

Thanks. I will definitely remember that. My hearing isnt too far off so we will see. It just sucks i have to move. But i guess you have to hit bottom sometimes before you can start your way back up. Here we go

Slaughter1984, I'm sorry you have to move and things are going so bad right now I hope you get your approval when you have your hearing and at least its not to far off. Hang in there take care and keep us posted we care and will be pulling for you .

So sorry to hear you aren't getting an OTR decision. But at least you only have about one month until your hearing date, so that is some good news, because it could be a lot later than that. I have been hearing of people just now getting hearing dates in Feb and March. When your lawyer submitted your OTR request, did he outline how he thought you met those listings?? I just wondered if they took that into consideration, or if he didn't mention the listings. Also, I think with you moving it shouldn't affect your hearing or anything, as I had an aunt who moved out of state before hearing, and had to come back to original state for hearing. So you should still have the hearing where they have it scheduled now. Things will get better for you. Im thinking the judge just wants to see your deformities for themselves. Im hoping things get better for you soon, and that you will get a Bench decision, and an approval the day of the hearing!!:angel:

I will find out more information when i see the lawyer on the 6th of december. The legal assistant i talk to all the time said it was defined but the judge said she wants a hearing. The only thing that bugs me is where i live they usually do a video hearing or whatever it is called so i am concerned that my deformities and how i move will not come out that well as i can barely walk most of the time or when i do it is with a major limp. IDK we will see i am doing my best to stay positive it is just getting really hard when i dont even have my wife by my side anymore.

I know you said you contacted ODAR and they told you to talk to your attorney and to stop calling, try contacting your local SSA office? They may be able to provide you with the information. I wish you all the best, sorry I don't have any other information for you.

maybe it won't be a video conference . Is their anyway that you can request a face to face hearing?

I had a video hearing too. The judge was on a HUGE big screen TV. There were cameras in every corner of the small hearing room, so the judge could see everything. I don't know how your hearing room will be set up, but at mine, the judge could see everything.

The ALJ, at this point, will primarily base their decision on the medical records, exhibits submitted by your attorney, and your answers to the questions he/she poses at the hearing. They have cameras and will instruct you where to sit so as to be optimally viewed and to view the judge on the screen.

Hang in there Slaughter. I know things are rough @ the moment friend. We are all pulling for you. I read your post about the OTR declination...what a bummer...but keep the faith!
