Post SURGEON CUTS MUSCLE VISUALLY IMPAIRS

Well I sure hope that there may be some good response out there on this, I took it all the way to the courts, this surgeon cut the inferior oblique muscle of the right eye while he was doing a lower bleph. Now this is an eye surgeon. Of course he knew about it from day one because of the "magic words " Tilted which any eye doctor knows means obliques are involved, referred to his own partner after he seen me the next day who this other partner has a speciality in muscles yet they tell me wrong eye and such, so you get the story took several months to even be able to know which eye, and then the condition does not come out, yet after pulling records he mentions a surgery possiblity in May, this surgery was done on 1/98 Now comes the better part, patient after waiting per their instructions both the surgeon and the partner of his, on the 7th month she gets outside opinion that these guys knew from day one, and that leaves me to have distorted vision in all fields of gaze and tilted double vision - disables me, but get this, in addition to the vision that he damaged, he gets the right to have his sexual molestation take place during the recovery room, which was suppressed from fear, victim meaning me had only one request please tell me what is wrong with my eyes. The attorneys dropped the sexual assault, then later after hearing that it was true due to a professional that tested for many hours, 4 hours of this and proved that all info was concise for 3 years, they put it behind and separate it. Go to court last week, now want to know the full justice, the surgeon and his partner get off, verdict says NO,, they were subject to a verdict form that probably caused confusion, they did not prove on the defendent side causation of damage although they did admit damage to oblique,, prove of causation should have been submitted to the other side. NOw they walk, I am trying to appeal what do I need, an expert lawyer so have found 2 but have to get my trial lawyer to contact a phone call right? This process ticks away I only have 3o days to appeal and guess what today after several days of begging hunting down an expert to do this I can't get my trial lawyers to even make that call. YOu put together what may be going on here,,,,,because my days are slipping, and I sit here damaged, disabled unable to work and Ihave a small girl. Oh yes, forgot to say this, the other side gets to sue me for all the costs of flying their experts and the time the experts put in, I don't even have money hardly to pay the electric bill. Justice is not for the poor, justice? I know that there should be many many out there that are eye surgeons or PS that can say that severing an oblique muscle is negligent and even if he did it with a laser trans-conv that this is not acceptable. I know it, but do they have the willingnes to say this,,,,,,,Ineed to appeal.... I need to do it fast see justice? Wow no money but trial lawyer can't even take the time to make one phone call to let the expert know if he can take the case and do the work for appeals? What do you think. Would any of you think that having an upper/lower eyelid surgery would give the surgeon a right to impair your vision by cutting muscles?

I am in same boat .had cataract surgery. 2nd day told DR I saw flashing lights and floters .He told me it was normal ,dont worry about it. 5 days later my retinia became detached.had to have emergency surgery. lawyer said I probably could not get them to pay expenses. Doctors are a bunch of Jerks in my book. one screws up and they rest protect him.

I don't mean to sound uncaring here. But you can not expect to get compinsation for a possible complication of surgery. Bleph and Cateract surgeries are considered elective and you need to ask questions about complacations before you have the surgery. I understand you are both upset but EVERY surgery has risks.
