Has anyone attempted to take legal action against a doctor for unnecessary surgery? In my situation, I feel that a conservative approach was not taken, and a more extensive (and expensive) surgery was done. This has caused much anguish and pain - especially since it has failed to produce the results requiring even more surgery if I want to walk without pain. Of course, it's only after the failed surgery that I found all these forums and thorough explanations for various foot problems and approaches. If we could only turn back the clock!!
And what surgery did you agree to and which did he perform? You had to sign a release for the surgery to be done. If he did a different procedure than what you agreed to, you should have recourse. If he did what you agreed to and you later found out that there were alternatives, I doubt you have any recourse. It's up to the patient to determine what options are available and then chose the one they feel most comfortable with.
