Hi:
I got a bunion surgery in both sides of my feet, the little toe and hammer toes 2,3,4th. The doctor told me that I will be ready to go back to work on 3 weeks because I was young. She cut both foot w/ 13 days apart(first left then right). I was unable to go back to work. I lost my job and my health insurance. She told me she won't be able to see me again until i got an insurance.
One i met her she gave me her cellphone, but once i have to call her on Sunday because I felt so much pain and needles pinching me all over my feet horrible! I was scared because it was a different type of pain. She asked me not to call her cellphone because it was for personal calls @ she was with her husband. Asked me to go to her office next day (Monday).
So, a friend of mine call a friend of hers, a student, and he listened to my symptoms and asked me questions such as, do you have fever?
In the first food, the pain was increasing rather than decreasing So I went to a city hospital because I did not have insurance. I had to wait for 5 months to get an appointment. Surgery was on August 2010, waited from December to May 2011
I continued having so much pain on the big toe and 3 & 4th (since the beginning they hurt). Three doctors told me that the doctor (podiatrist) cut too much bone and not straight and there was nothing they could do to help me.
I went to see her & she said that everything was perfectly fine. I am so depressed because I am in so much pain & they told me that my only solution is to take painkillers because bone does not growth back.
I was perfectly fine except for discomfort wearing shoes, and now I cannot walk comfortably, cannot exercise as I used to, cannot dance, and cannot wear heals even 2".
The podiatrist who damage my foot put cortisone injections but I am still in pain. She does not want to be responsible paying for my medicine. She just got lost & denies any wrong doing.

I should have gotten the surgery with an orthopedic in a hospital, not in a clinic where she is the boss. Nobody to complain and she lies on my face. Her word against my word deal.
What should I do?

I would try to seek free legal advice if possible or Legal Aid. Sounds like she messed up if three other Drs. are saying she cut too much bone and you are in so much pain.

If done properly no bunion surgery, especially bilateral surgeries would recover to the point of working in 3 weeks. It most definitely sounds like the physician was more interested in getting your money than doing what is best for you. Cutting too much bone, most often, would not cause excessive pain. The problems from this come in the long term when there is an unbalance in weight bearing amongst the metatarsal bones.

But don't for a second think that her selfishness and poor medical ethics is related to her being a podiatrist. There are just as many orthopedic surgeons and other physicians that would treat you similarly. I know from experience. Did you file for temporary disability? If you did, your employer would have no legal right to fire you. The are legally obligated to let you obtain medical treatment and provide accommodations if you are temporarily disabled.

My suggestions are to file a malpractice case against the physician. Were you aware that 90 days after a surgery such as a bunion procedure, office visits and treatment related to the surgery is covered already by the initial surgical fee. By here denying you care related to the surgery within that 90 days, she was 100% in the wrong and practicing against the law.

Thank-you for answering my inquirey, and I am so sorry to hear of your experiance, I dont know how these people in the medical proffesion live with themselves, and I do hope you take the advice of the other replys, to go further with this, and have the doctor face up, and do the right thing. Meanwhile take care, and I wish you well. Let us know how you are doing, you have certainly enlightend me, as what to expect from this surgery, and certainly given me room for thought about going ahead with it. As I have not heard one positive post on this combo' surgery.

thank you so much. I want people to know how risky is this surgery, as well as in disadvantage when doctors make mistakes. A patient has more to loose than a doctor. I hope someone helps me with my situation.

I have been trying to get a lawyer but they told me that this surgeries are always poorly performed and unless there is a missing toe they can prove malpractice. However, a law firm took my case by showing my x-rays to their specialist. He/she will determine if my case proceeds.
I hope so because it is not fair.

Thank you for replying to my posting. I went to see the podiatrist and she kept lying right on my face. She said that everything is all but injected cortisone, did not help, and gave me samples of Biofreeze to apply. She got lost and it is not calling to ask me how I am feeling. She is a horrible person and doctor.

You are right about the bone, the bone does not hurt but my big toe hurts so much and get stiff. Also she cut too much my third toe and that one hurts a lot. Someone told me about reconstructive surgery.

Hope a lawyer help me because they have told me that unless I do not have a missing toe or something really horrible doctors are free to go.
