Re: Ssi Back Pay For Children (dedicated Account)

Let me tell you guys about social security. They do not have the right to tell me I cannot spend my son's money. I will take and spend what I want and when I want. then they have the nerve to tell you not to have more than $2000 in the account, or they will site you for overpayment, but they say do not touch the money. They sound so contradictive to me. I take care of him, not them. I need it to buy his christmas gifts, because i just lost my job. We fought hard for this money, and I will use it when I need it. Then if you let that money just sit there, it could become an overpayment, and they will stop your monthly check. This is ridiculous, but true.

We fought for about 3 years and finallly won......the back amount was $16,000 i had to open the DEDICATED account.....the first payment was in jan. o8 it was $2,000 i spent it on rent, utilities, food, clothing....stuff my son needed.....so in sept 08 i recieved a call from s.s. saying i misused the funds and that i will have to repay it outta my pocket(i have no money to pay it back)...they had me agrree to pay back $20 a month...which i havent payed.....i feel this money should be used on the child the way i see fit.....he is my child and i know what he needs...anyways after i agreed to pay it back i had to sign a paper saying that i would.... then they would deposit another $2,000...... which i have spent on the same items listed above and also some christmas gifts....so i'm not sure what is gonna happen around feb. when they will send the paper asking how it was spent and on what....which will be the same items i spent it on b 4.....if you think about it..the back pay is the amount you would receive each month.....which you can use on rent, clothing, etc. so i'm not sure why they are being soooo strict about what you can spend it on....not sure if i will get in trouble or not....anybody know anything more about this issue....i would love to hear what you know....so i willl know what to expect....thanks =)

Re: Ssi Back Pay For Children (dedicated Account)

Well right now i'm waiting for the last installment of my sons back pay if it ever gets in since Social Security thinks of only themselves.. I got a call from them wanting some stuff sent it in by the date due and that was Nov 30 and it is now almost a month later and still haven't heard a blasted thing.. I called a few times and of course we will call you back and does anyone no cause the stupied claims guy won't. So called again this week and guess what he is on vacation..Well Merry Bloom Christmas to him the stupied jerk.. I can't believe we have to rely on them to get the money that we had to fight to get.. Its owed to us or our children. The money we get in back pay mainly goes to pay late bills that keeps a roof over his head and food on the table..why should we have to keep tabs on it for them.. And personally I don't keep record of everything I buy or pay or whatever..

Well put! You are right though. I checked into it so go ahead and spend away. If they have a problem with it there are all sorts of loopholes to fall through, although those loopholes are for the benefit of our children as we deem fit. Case Closed!

Re: Ssi Back Pay For Children (dedicated Account)

My son was on SSI when young, up until the time I became approved for SSDI.
The changes that are now made for SSI and children are tight. SSI leaves no room for error. It never use to be like that. ALl I had to do was fill out a form for SSI and tell them if their was any money saved, and what the money was used for. Never like it is now.
How stressful this must be. I do not have the answers , but feel badly that parents cannot use some of that money to provide basic needs for their disabled child. THat is what SSI was ment for , and it helped me tremendously .
I have to wait until my son reaches 18 yrs. old in order to apply again for his SSI. I think it becomes easier when they reach 18 and can be on an adult record.

Re: Ssi Back Pay For Children (dedicated Account)

I totally agree with you. My son is 13 and he was fully approved, after a long wait, and numerous doctors and psychiatric treatments, and also school, even so I had to hire a lawyer to get approved. Well now his back pay is being paid in 3 installments, and they are asking me when and what did I spend the money in. I am a disable person myself (fibromyalgia and chronic arthritis), so that means I can't work either. And now they say I have to pay it back, all his meds and doctors and therapists are covered by medicaid. He is in a public school, so they provide the books and materials for studying. So I ask myself what can I use this money for? I had an eviction notice, lost my car due to an error of Geico, have BEDBUG problems, had to toss away all my furniture last year, gues what; I live in housing projects, they "sprayed", but these critters won't go away. The new furniture that I got is infested too. So I have to get new furniture. My car which I had to buy and old one has no heat/ac, needs a new door hinge, new tires. etc. And I cannot even use this money, which I consider is in benefit of him, If I don't pay my rent, we end up in the street, If I don't get new furniture AGAIN, then I am negligent as a parent, and I need a car to bring him to his appointment because of my medical condition. I mean so many restriction with a money that in first place, I believe, he has the right to get, he sees me struggle and tells me: "mom, why can't we use the money that's there, we really need it". It is so confusing with all the laws and contradictions of Social Security; it's so ridiculous! You know I can keep going and going on so many examples. I mean why do we have to suffer and struggle while the money and the help is sitting there in a so called "dedicated account"?

Re: Ssi Back Pay For Children (dedicated Account)

I feel the same way about these crazy rules! I am a single mother of three and the middle child was granted thousands, but my car is on empty and just ran out of diapers and pull-ups yesterday. I took two months off of working to finish my education. I take the monthly to pay rent, and refund check paid up everything else. My daughter doesn't need a wheel chair or machines, so I guess the money will just sit there!? If she did need a machine, we'd be in big trouble because right now our budget is zero and I can't use the money for lights. "Yeah, she has a brand new wheel chair, but she hasn't ate in three days because SSI told her it wasn't approved yet??? Someone needs to go back to the drawing board on this one!! I have never done drugs or been in any real trouble with the law other than traffic tickets. Why don't they just screen us and weed out the bad apples?? I can't believe we have to beg for money that's owed to us! I thought we were going to be ok, but now I just don't know.
