Reconsideration stage question....

I got denied in July and finally heard back today that they are going to send me in for a psych exam. ( I had already done a physical exam before my first denial) Why wasnt this done before my first denial? I am currently recieving treatment for my anxiety/ depression and OCD, but I thought if they needed that info it should have been done in the first round?
Does it look bad for me that its been 4 months since I have heard from them and now they want me to do a psych exam? My therapist said that he turned in the papers they requested MONTHS ago. Sorry just confused! thanks!

I would think it looks good for you the fact they are asking for more infromation seems like a good sign they are maybe considering it futher than just a flat deniel thats just my take on it . I wish I really knew the answer for you to ease your mind I can tell you any new information you can give will be very helpful to your case did you fill out the RFC form? I won on reconsideration and it took 8 months total. but I got denied the first time in 4 months but then it took 4 months after the reconsideration when in to get approved but every case is different Do you have a lawyer helping you maybe if you do ask him about that form he will know what it is are you can ******** it from the ssa website and have your DR. fill it out and sent it to ssa are any updated things that has happened since your case started. Hang in there keep checking this board there are a lot of knowledagle people on it that will be able to help you Again good luck to you try not to worry I know you wont be able to do that because its a hard process to go thru but please know people care and we are here to help anyway we can hang in there.

Allsup prepared me beforehand and told me not to worry too much if I was denied at these 1st two levels. Just make sure you attend any CE's SS sends you too. It is critical that you comply will all requests and jump thru all the hoops they make you jump through. It is a real PITA but take solace in the fact that you are not the only one. The majority of us who are approved now have gone thru the same things you are going thru now. Just appeal and keep going forward.

Hi there,

I also think it is a good thing that they want you to go to a psych exam ... I think it means they are considering it, and want more info.

I had never been sent to one of their doctors, so it was a complete surprise to me to be sent for a psych exam, since my disability is 100% in my back. I even told him that I did not understand why I was there - and he told me it was just another step in the process.

It lasted about 40 minutes, and the psychiatrist was very nice. He asked the usual questions: who is president, what city are we in, did I hear voices and was my childhood happy.

I was very surprised and happy that he spent half the time asking about my daily living and how difficult it is for me to do simple daily tasks. I was not expecting him to ask about that, and it made me feel like he understood how difficult life is for me.

At that time, I had been denied 5 times, and was on my second case. I was approved a few months after my Psych Exam. So go, and hopefully you will be approved soon afterwards!

Yeah, I agree with what Gayle and Jgrangran said. I actually had the same thing written in my reply and edited it before posting because I thought about all the randomness of the entire SSDI process. On one hand, you could say you had enough medical documentation where they thought they could make a disability determination without sending you to a SS CE ( consultative examiner) for a CE (consultative examination). After review, they denied you. You then appealed. You could then argue that perhaps they really can't conclude from your medical records alone and need more evidence before making a second decision, thus the CE. OTOH, one could say after reviewing your medical records, they concluded that your records alone did not substantiate a LTD according to SSA rules and therefore they denied you.

You could also argue that if they send you for a CE @ level 1, then perhaps your medical records are indicative of total disability and they need to make absolutely sure, thus sending you for the CE or CE's at level one like they did in my case.

Due to what I just said is why it is important not to let any initial denials discourage you. Level 3 is still where you have your best chance of proving your case and getting approval. Level 3 IMO is where your attorney or non-attorney rep. earns his/her/their keep.

What Gayle said below is why I try not to overthink (over-analyze) about the CE's. My disability is primarily mental and they sent me for a physical CE and I even had to go to a local hospital to have x-rays taken of my back. I have had back pain like most people in my life but no significant back problems that prevented me from working any longer than 2 weeks in my entire life.

Hey Blueskies14, just to let you know if your back keeps hurting xray doesn't show everything it wasn't until they did an MRI that they found my two ruptured disc so remmber if you keep hurting don't settle for them saying I don't see anything because you could have indeed have something just a thought. Thank you everyone! I was just confused because everyone told me that with reconsideration, it would be a couplw months then I would get my denial, which I was expectibg soon. Then they call up yesterday to let me know of my appt on the 8th. I just qas confused of if they needed that info why it was not done the first round. I did have a lot more medical records from six specialists, so hopefully it helped.

thats aweaome you got it on reconsideration! yes I do have a lawyer but im not sure how much they have helped so far. My condition is mainly physical ( dysautonomia postural orthostatic tachycardia syndrome and orthostatic intolerance.) but I do have mental problems from it. what is the rfc form??

Its a form that the DR. fills out it help ss see what limitations you have your lawyer will know you could ******** it from the ssa website and have the DR. fill it out. If you have new edvince let your lawyerknow so he can let ssa know it. everything helps please keep the faith everyone is right about what they said your best bet is to hang in there and stay busy and try to pass the time away sometimes sadly it takes so long .

oh yeah my cardiologist and neurologist filled those out after my first denial. I dont know why they didnt ask for that on the first round either?

The odds of getting approved at level 2 (reconsideration) sadly is approx. 13%. This is why if you have any new medical evidence that substantiates your disability, it is critical to have it submitted in order to be in that 13%. At this level, you will have a different DDS adjudicator team (medical or psychological consultant and a disability examiner) than the ones who denied you at level one but they will evaluate your claim the same way adjudicators 1 did who denied you at level 1 so be sure and submit any new medical evidence.

Hi there,
Having a lot more medical docuementation could result in a approval at the reconsideration level. That is what DDS is looking for. Blue was correct, a different DDS woker will look at your claim to make a final decision . Sending you to a CE will help you have more evidence supporting your claim. I was also approved at the reconsideration stage. I was not sent to a CE , but had a lot more medical docuementation . my son was sent to a CE on the initial stage . The Dr. had him do tests which he could not do most of them . It took a couple months later and he was approved .
unfortunately the statistics are low for an approval at the Reconsideration , but not impossible .

Right is not impossible I know three people on this board that won on reconsideration stage so if you have more edvidence please get it to your lawyer and make sure he turns it in . God Luck we will be pulling for you.
