Wow footny, this is what all LTD claimants fear, including me. I am so sorry this happened to you. This is so bad IMO. Even after the SSDI offset, were they still having to pay you a substantial amount?
They do surveillance on some claimants but this is uncommon for the majority because it is so expensive. The insurance company is not going to do this unless they have good cause to believe it will give them the ammunition they need to terminate the claim. Many people are paranoid however because you just never know, esp if the carrier starts badgering you and your doctors monthly for medical proof of continuing disability.

I got cancelled before I had to go in front of a judge to get SSDI. It was a bad year, that is why I have two lawyers. I don't those months on anyone. So yes every month I am completely stressed out to see if I get a check or a letter from my lawyer or the LTD company or SSDI. It is not fun to live in fear like this.
I agree footny. To live in fear like this is really awful. I actually wish they would ammend ERISA a little more to protect disability claimants. That would at least give us, the claimants, a little more peace of mind when we have to file a claim for LTD. No one wants to be approved but then have to live in constant fear each month not knowing if you are going to receive a deposit into your bank account or a termination letter in the mail.
You are correct. There are "reserves" as it is called to pay all outstanding claims. That is the FIRST thing an insurance company has to pay, and money is set aside to cover that.
The insurance company has I guess insurance in case they go belly up. One of the big ones, bought another one last year. Yes, I am totally paranoid, I have no choice but to get some errands done today, I try and do them as quickly as possible, because if I linger, I am going to be in so much pain. My lawyers sect told me the P.I. will put a camera on his hat. She said you just don't know.

Footny, if you do not settle, how many more years are they obligated to pay you provided there are no early terminations. In my case, I am looking at 15 more years.
I know it is hard, always wondering if you are being watched or not. Being disabled does not mean you have to be a complete invalid.
I actually think everyone on LTD (not so much SSDI) suffers from a bit of paranoia, including myself.
