Fired from job /LTD & paying back SSDI?

A neighbor won SSDI, but he was fired from his job, and no longer has coverage from LTD. He did sign a clause to pay back if he won when he had field for SSDI. Does he still have to pay back the LTD since they fired him and he no longer is covered under their plan?

Just because one loses their job with an employer, it doesn't mean they lose their LTD coverage. If they were already disabled prior to losing their job, the coverage continues as long as the disability continues. Unless they were cut off LTD for another reason, such as the change of definition where they look to see if you are not just disabled from your OWN occupation, but also ANY occupation. Either way, yes the LTD company needs to be paid. They regularly run reports from the SSA and they find out if people are getting SSDI. You'd hate for your neighbor to spend all that money and then have to pay it back because with just SSDI as income that would be hard to pay back. A lot of companies only allow 2 years to pay it back so if it was spent, the LTD could take their whole SSDI check to pay them back. So, my advice is to double check with LTD because if they think they are losing LTD due to employment ending, that is false, and secondly, pay the LTD and avoid any future problems!!

This is what happend to him. They said that he could work other jobs, althought his doctor stated he could not do these jobs. So they cut him off and he was without any income for the past 6 months. I know he would not have to pay the last 6 months back, but your saying he still has to pay the other time back? Thanks

Yes, legally he has to. If he doesn't, and they find out -- which they most likely will -- he will have to pay it back then. It will be easier to pay when he has a lump sum now than later after its all gone. I used to work for an LTD company so I know all too well that they check into all people that possibly owe them money and check with Social Security regularly to see who has been approved. I would just save a big hassle and let the ltd company know right away.
