Questions about SSDI back pay and payments

New to posting but have been reading...a lot
I got my fully favorable decision in the mail today 3/23/13 but I do owe defaulted federal student loans but I am making small monthly payments of 10.00 a month...wondering will my back pay be garnished? Also, owe small amount of taxes to the IRS and small amount to State taxes...will these also be garnished? As of 3/15/13 my paperwork was at the payment processing center in Baltimore Maryland..wondering how much longer and also wondering if these garnishments will hold the entire process up??? I did want to mention that on 2/25/13 the ALJ told me that day that I would get my disibility.

Re: Questions about SSDI back pay and payments

Hi you need to apply for a total disability discharge from your student loan. Apply through your loan holder. Good luck.

Re: Questions about SSDI back pay and payments

I just had my phone interview yesterday to see if I am eligible for ssi. I was awarded full disability at my hearing on 4-11. I still have to send in my husbands pay stubs for the SSI thing, but I was also wondering how long back pay for ssdi took. I guess I am just confused as to what is going on. I won my case, so that means I will get ssdi? What if I dont win ssi? I just don't understand how it works ugh. Congrats on your favorable decision!

Re: Questions about SSDI back pay and payments

SSDI is what you get if you worked enough quarters to collect and become disabled. SSI in needs based according to family income. The best way to explain it that many years ago the government determined a amount a minimum amount that someone would need just to survive. If your Social Security or SSDI are under the amount for that year then they check to see if you qualify for SSI. For example the SSI amount this year is $710 so if your SSDI benefits is under that they will check to see if you or in your case your family also qualifies for SSI. If your husband makes very much at all you more than likely will not qualify although the amounts are based on income and family size so if you have children the amounts he makes can be more. For a couple this year you can not make more than I think it is $1151 it goes up a little bit for each family member. Some have reported delays in getting back pay while this decided so if you know you would not qualify based on your spouses income you may see if it will delay things and if it will see if you can waive it somehow.

Re: Questions about SSDI back pay and payments

Thanks so much! That really helped me a lot. I am truly not sure if we will qualify. My hubby has a decent job now, so it really would be hard to tell. Thanks again though for the explanation. It really did help and stuff
